Terms and conditions

Charges apply for the consideration, administration and issuing of permits. These charges vary by permit type and are reviewed on a regular basis by the Council’s Cabinet. Current parking fees and charges can be viewed here.

All parking permits whether on paper or paperless are issued at the sole discretion of the Council and may be withdrawn (with notice) at any time by the Council if these terms and conditions are not met, as they remain the property of the Council.

The following are our general terms and conditions which apply to most permits issued by the Council for use in resident permit-controlled parking zones. Permits issued to contractors, landlords, agents and care workers are subject to additional specific conditions of use as stipulated in the terms and conditions that will be printed on their accompanying letter. Please ensure you read these before proceeding with a purchase.

  1. Private cars, minibuses and motor caravans not able to carry more than 12 passengers, and light goods vehicles (Max Laden Weight 3500kgs) may use a resident parking permit issued under the following conditions unless there are specific provisions in place on street to the contrary.
  2. Obtaining any parking permit through false or inaccurate information or using it in a way not prescribed within the terms and conditions relating to that permit type may result in its immediate cancellation. The Council will retain any money paid and refunds will not normally be given.
  3. In making an application for any of the permits offered by the Council, the applicant authorises the Council to make any further checks as it sees fit to validate the data provided. Applicants may be asked to supply documentary proof of residency, business use or ownership of vehicles
  4. Any person making a false statement for the purpose of obtaining a residential zone parking permit shall be guilty of an offence (Section 115 (2) Road Traffic Regulation Act 1984).
  5. You should be a resident of the property to hold a residents’ parking permit.  Resident parking permits inc. visitor permits should not be used by landlords or property owners as an alternative permit is available to you to park whilst accessing your property.
  6. Residents’ parking permits may only be used by the named person it is issued to, who can provide upon demand evidence of ownership or tenancy of the address, along with evidence of car ownership or permitted use of the registration number stated on the permit.
  7. You should not hold a parking permit for any other address than that of where you reside. You cannot also have a parking permit for parking at another address, for example, that of a family member, partner, friend or for car share purposes, even if that permit would otherwise be a used part of the allocation for their address.
  8. Parking permits issued for business use cannot be used primarily for commuting purposes. The vehicle must also be used on a daily basis for business-related activities, for example, routine daily deliveries.
  9. A parking permit does not guarantee a parking space outside the property. The vehicle is only permitted to park on a road in the area or zone indicated on the issued permit.
  10. The Council reserves the right to refuse an application or renewal of any permit described in this document if there has previously been a fraudulent application made or evidence of repeated misuse of a permit by the applicant.
  11. In applying for any permit offered by the Council an applicant accepts our terms and conditions in relation to the permit type being bought. A copy of the terms and conditions for all permit types offered is printed on the rear of the letter accompanying any permit sent by post.
  12. The Council reserves the right to update and vary the terms, conditions and charges from time to time or as required due to legislative changes and amendments of any Traffic Regulating Orders.
  13. All permits issued by the Council whether issued as a physical permit or permission granted by means of a virtual permit are done so at the discretion of and remain the property of the Council at all times and may be cancelled or withdrawn by notice at any time by the Council.
  14. A physical parking permit should be returned to the Council when no longer required or photo evidence of a destroyed permit emailed to parkingpermits@devon.gov.uk. Digital permits should be cancelled by the permit holder online or via the MIPermit app.
  15. Annual parking permits are valid for one year from the date of issue and can be renewed online. Parking permits are only valid for use in the zone, road or location specified on the permit.
  16. A vehicle may not use more than one active parking permit at any time. If a vehicle is found to have or to be displaying more than one active permit for different zones, the Council will consider the first permit issued by date, invalidated by the later dated permit and may issue a Penalty Charge Notice.
  17. Physical visitor parking permits should be scratched off and required fields completed in ink in accordance with the instructions stated on the permit, before being placed in clear sight on the vehicle dashboard.
  18. The MiPermit account holder is responsible for ensuring any vehicle being used by a visitor to their address and parked nearby in a permit only space has been registered and allocated visitor hours for the duration of their visit to the account holder’s address.
  19. Physical parking permits must be displayed in the front windscreen of the vehicle so that all the printed details can be clearly seen and read by a civil enforcement officer or police officer from the kerbside where the vehicle is parked. Failure to clearly display a valid permit will result in a Penalty Charge Notice being served.
  20. It is the driver’s responsibility to ensure that the vehicle is parked safely and wholly within the confines of a marked parking place. The vehicle should not be parked wholly or partly on a footpath or verge, or in a hazardous manner.
  21. The vehicle must be moved on the instructions of a police officer, traffic warden, council officer or utility company contractor in pursuit of their duties.
  22. All vehicles must have a valid MOT, insurance certificate and Road Fund Licence to use a resident’s parking permit in an on-street parking place.
  23. All parking permits are non-transferrable. It is your responsibility to inform the Council of any changes of address or changes to car registration details on physical permits as soon as possible so the permit can be updated or cancelled. No refunds will be given for part used, damaged or invalidated physical permits.
  24. Altering or changing a physical permit will render it invalid and it will be considered as invalid if used in any other vehicle other than that specified on the front of the permit.
  25. MiPermit account holders are responsible for updating any change of address or car registration details via their online account. Existing permits can be either changed or cancelled for a new permit bought for the new registration number. Unused full calendar months on any cancelled permit will receive a pro-rata refund.
  26. No refunds will be given for part used, damaged or invalidated physical permits. Digital e-permits can be cancelled for a pro-rata refund for whole unused calendar months or whole unused visitor hours.
  27. Student parking permits are issued for 12 months but will automatically end on 31 August unless cancelled by the permit holder prior to that date. Any remaining full calendar months at time of cancellation will be pro-rata refunded.
  28. The Council reserves the right to withhold access to on-street parking permits to those persistent evaders with outstanding unpaid penalty charge notices until all outstanding notices are fully paid.
  29. The Council reserves the right to retain any money paid or pro-rata refund due in respect of a permit if the Council has to intervene and cancel an account or permits for new owners or occupiers to access their entitlement to permits.
