Terms and conditions for placement of rails, beams and cranes over the highway


  1. When not in use, the crane will comply with ‘out of service’ precautions as defined in the Construction (Lifting Operations) Regulations.
  2. The crane jib must be installed at such a height as to be well clear of any adjacent buildings, attachments or wires for all 360 degrees of its travel.
  3. The design of the crane base must be designed by a competent person and take into account the particular ground conditions at the site. Calculations and information on ground conditions shall be provided if specifically requested.
  4. In the interests of safety, although it is understood that the jib of the crane will over-sail the highway, on no account shall any operations be carried out over the public or vehicles on the highway.
  5. Where there is to be loading/off-loading to/from the highway, then all traffic management details (such as traffic controls, signing and barriers) and an additional licence under section 171 of the Highways Act 1980 will need to be obtained from the Council’s Licensing Team.
  6. If/where building materials are required to be deposited/stored on the highway, an additional licence under section 171 of the Highways Act 1980 will need to be obtained from the council’s licensing team.
  7. In the event that signs and barriers are disturbed at any time and the public exposed to danger, as defined for any individual instance by the Council, the council shall require you to attend to the matter immediately. In the event that you do not/cannot comply, the Council shall make such provision as is necessary for the maintenance of public safety and the costs of such shall be reimbursed by yourselves.
  8. Any special traffic arrangements required for the removal of the crane shall be agreed with Devon County Council.
  9. I confirm that an operational statement is in place and available to view on request.
  10. A 12 Month thorough examination certificate conformity certificate (new cranes) been obtained?
  11. All items being lifted are within the maximum safe working loads (including at extension if applicable).
  12. I understand that I am responsible all operations carried out by my contractor.
  13. I understand that my contractor must not undertake any work until I have received a licence from Devon County Council
  14. I agree to indemnify Devon County Council against any claim in respect of injury, loss or damage arising from the works
  15. I understand that the licence to carry out the work is only valid for the period stated in the licence and that operations needs to be completed within that time
  16. I confirm that all equipment conforms to the current British Standard for Cranes (BS 7121 – 1).

This permit is for the crane oversailing only the highway including footway and does not relate to any private land or buildings that may also be over-sailed.
