Minerals and Waste Development Scheme – Fifth Revision

Introduction

A fourth revision to Devon County Council’s Minerals and Waste Development Scheme was published in July 2015 but became out of date due to subsequent adoption of the Devon Minerals Plan. This Fifth Revision comes into effect on 26th March 2018.

Devon County Council adopted the Devon Waste Plan in December 2014, and the Devon Minerals Plan in February 2017, and these are monitored annually to assess the need for partial or full review.

This Minerals and Waste Development Scheme will be kept under review through Devon County Council’s Monitoring Reports and will be subject to further revision when necessary.

The geographical scope for the Devon Minerals Plan and Devon Waste Plan is that area for which Devon County Council is the minerals and waste planning authority.  This area excludes Plymouth, Torbay and the National Parks of Dartmoor and Exmoor.

Devon Minerals Plan

The Devon Minerals Plan was adopted in February 2017 and includes provision for monitoring of its delivery, including potential requirements for an early partial review of the Plan in the event of variations in levels of mineral production, non-delivery of proposed sites, closure of existing sites, or variations in levels of cross-boundary mineral movements. In the event of such a review being required, a further revision of this Scheme will be prepared indicating the timetable for the review.

Devon Waste Plan

The Devon Waste Plan was adopted in December 2014 and includes provision for monitoring of its delivery, including a potential requirement for an early partial review of the Plan in the event of landfill capacity being utilised at a faster rate than projected. In the event of such a review being required, a further revision of this Scheme will be prepared indicating the timetable for the review.

Under Regulation 10A of The Town and Country Planning (Local Planning) (England) Regulations 2012 (as amended), review of the Waste Plan will be required by December 2019. If no earlier partial or full review of the Plan is triggered by a monitoring report, a programme for its review will be provided in the next iteration of this Scheme.
