Section 106 contributions, payments and income – Tavistock bus services

Request 1 – please provide the following information relating to S106 contributions made by developments in Tavistock since 2005:

* The location of the development

* The planning permission reference

* The details of the S106 requirements for local bus services serving Tavistock – financial contributions and physical provision (bus shelters etc)

For your information, I am aware of contributions due from the following sites but there may be more:
* Redrow Homes, Tiddy Brook
* Tesco, Plymouth Road
* Callington Road (Bovis Homes)
* New Launceston Road (Cavana Homes)
* Embden Grange (Davis Wilson Homes)

1. ‘Tiddy Brook’ Plymouth Road / Launceston Road (WD/7177/2005)

£225,000 towards ‘Public Transport’ prior to occupation of 50th unit to fund the operation of a bus service for 3 years from the date three months after the contribution was received. The Agreement identified, in Schedule 1 (available to view on West Devon Borough’s website) that it was envisaged that that the bus would operate with a 30 minute frequency between 0700 and 1900 hrs. in a minibus type vehicle.

2. Tesco, Plymouth Road (WD/00601/2013)

£165,000 (index linked) towards ‘running existing bus services’

£55,000 payable prior to occupation

£55,000 payable on first anniversary of occupation

£55,000 payable on second anniversary of occupation

3. New Launceston Road (WD/2022/2016)

£135,000 towards ‘the continuation of the 89 bus route for two years’

Sum to be payable prior to occupation of 50% (74 units) of the units on site

4. Callington Road (WD/00554/2013)

£500,000 towards bus services

£100,000 prior to occupation of 50th unit

£100,000 on 1st anniversary

£100,000 on 2nd anniversary

£100,000 on 3rd anniversary

£100,000 on 4th anniversary.

5. Embden Grange (WD/0610/2015)

£195,000 towards bus services on the town bus route 89 (or subsequent service)

Payable in four instalments, but already paid in full.

PLEASE NOTE:- All monetary figures above are to be ‘index linked’ and the figures included above are the original figures included in the Agreements.

Any developments before the earliest listed above that may have been required to contribute are no longer available on records.

Request 2 – please provide the amounts, and dates, of payments received by the County Council for local bus services serving Tavistock in respect of the developments identified in Request 1.

  1. This amount was obviously received at some time but as it was more than ten years ago and was to run for the first three years of the service, there are no details of the actual amount received
  2. £171, 707.31 received 22nd September 2015
  3. First trigger not yet met, anticipated Spring 2022 – no money received nor required
  4. First trigger not yet met, only around 35 occupations – no money received nor required
  5. £195,000 received in June 2019.

Request 3 – please provide the amounts still due to be paid in respect of the developments in Request 1 and the expected dates of payment.

Amounts from 3 and 4 above are still outstanding in full. When they are triggered will affect the amount to be paid due to index linking.

Request 4 – please provide details of how the moneys received from the developments in Request 1 have been expended:

* The bus service involved

* The date of expenditure

Circa the 23rd of each calendar month for the period of operation of the service as set out below with each provider.

Bus service subsidy agreement under the terms of the Transport Act 1985.
