With regard to correspondences, this information relates to the pre-application stage and the related discussions and advice. Devon County Council can confirm that this information is held, however, the information is being withheld from disclosure under (Regulation 12(5)(d)) (Confidentiality of Proceedings).

Pre‑application planning advice forms part of a structured and established process intended to assist early engagement, identify potential planning issues and promote better‑quality planning applications. The authority considers that disclosure of pre‑application advice would be likely to adversely affect the confidentiality of those proceedings by undermining their integrity and effectiveness. This could discourage open and frank engagement between applicants and the authority, to the detriment of the planning process as a whole.

It is DCC’s view that disclosure would have an adverse effect on the confidentiality of the pre-application process, as it would damage the general principle of confidentiality. 

Devon County Council has considered the public interest in releasing this information and recognises that there is a public interest in openness and transparency. However, the balance of public interest weighs in favour of withholding this information from disclosure to protect the confidentiality of the pre-application process and because opportunities for public debate will be available after the planning application is submitted and in advance of decisions being made.
