British National Overseas Visa Holders and School Places

Information about Hong Kong citizens who are BNO Visa holders and school places:

1. How many applications for a primary school place have been received by the local authority, where the applicant is a British National (Overseas) visa holder:

a. For the 2020/21 academic year (please indicate how many were successful)

b. For the 2021/22 academic year (please indicate how many were successful)

2. How many applications for a secondary school place have been received by the local authority, where the applicant is a British National (Overseas) visa holder:

a. For the 2020/21 academic year (please indicate how many were successful)

b. For the 2021/22 academic year (please indicate how many were successful)

It would be unlawful for Devon County Council to collect this information for Admissions Purposes.

The Department for Education School Admissions Code 2014 states:

2.4 In some cases, admission authorities will need to ask for supplementary information forms in order to process applications. If they do so, they must only use supplementary forms that request additional information when it has a direct bearing on decisions about oversubscription criteria or for the purpose of selection by aptitude or ability.

Asking where the child is arriving from would have no bearing on the outcome of an application and it would not be lawful to ask this on the application form.
