Summary of Matter or Issue Requiring Decision:

6-month Extension to s75 agreement between NHSE and DCC describing the commissioning responsibilities of the two parties in respect of the provision of social care for eligible prisoners within Devon 3 prisons.

Summary of Reason(s) for Decision Taken:

Extension at the request of NHSE to support NHSE’s recommissioning of joint health and social care services to Devon Prisons.

 

NHSE is the lead commissioner of health and social care services in Devon prisons and the contract for service provision is supported by a section 75 agreement allowing NHSE to commission social care services on behalf of DCC.

 

NHSE intends to extend the contract for health and social care from March 2022 to Oct 2022, to allow sufficient time for a re-procurement. The section 75 agreement will have to be amended accordingly.

Summary of Alternatives or Options considered and rejected:

To refuse to agree to the contract extension and by inference the extension to the sec 75 agreement. To do so would mean that current contract would expire 31st March 2022. DCC would have to recommission social care services for the interim 6 month period on a spot contracting basis from existing community based personal care providers. The benefits of a jointly commissioned health and social care service would be lost in terms of operational flexibility and efficiency and it is extremely likely that costs would increase significantly.
