County Solicitor - Jan Shadbolt
Initial Assessment of Complaint made against a County Councillor in accordance with the Council’s Guidance/Procedure (April 2015)
To take no further action in respect of the complaint, following consultation with an Independent Person appointed by the Council in line with the above Guidance/Procedure at https://www.devon.gov.uk/index/councildemocracy/county_councillors/councillorcomplaints.htm
No evidence to support any allegation that the subject member had failed to adhere to the Code of Conduct or of any potential breach that might warrant a full investigation; that the actions of the subject member were entirely proper and could not have resulted in any breach of the Code; and that a number of the issues raised by the complainant would not in any event meet the requirement to warrant further action and should have been pursued under the Council’s separate complaints procedures.
All complaints must be assessed to see whether the alleged behaviour falls within the Code of Conduct; to see if there may be a case to answer or if, for example, a local settlement can be achieved or broker a conciliation between the subject member and complainant without recourse to the full process
A copy of this decision and any supporting documentation considered by the Officer taking this decision may also be made available or inspection by the public at the Council’s Offices or posted upon payment of any copying and postage charges. Any member of the public wishing to take up either of these options is asked to please ring 01392 382888 or email: firstname.lastname@example.org
