Please advise the current number of staff you have employed on “zero hours contract”.
There are in total, including schools, 21 employees on a ‘Variable Hours’ contract. If we were to exclude schools, the number of corporate staff would be 4.
Please classify according to the official definition: “They are on call to work when you need them. You do not have to give them work. They do not have to do work when asked.” Contract types and employer responsibilities: Zero-hours contracts.
Devon County Council have guidance for managers about Variable contracts. It is assumed that the employee will be available for work, unless they inform their manager to the contrary, giving an agreed and specified notice period. Managers must give employees written notice of the hours and days they will be required to work at the start of each assignment. Managers must give one week’s notice of any changes to shifts. Variable hours contracts can be either:
1. A range of weekly or monthly variable hours. The hours can be varied by agreement or, with an agreed notice period, within a range of variable hours either side of a contractual midpoint. E.g. Contractual midpoint of 15 hours per week varying within one fifth of the midpoint. Employees would work a minimum of 12 hours and a maximum of 18 hours per week.
2. No minimum working hours. Employees will be given written notice of the hours and days they will be required to work for each assignment.
