On 10th February 2023, Devon County Council advertised proposed changes to the Devon County Council (Various Streets, Devon) (Waiting Restrictions & Parking Places) Amendment Order in Challaborough. The reason for the proposal was noted as being to resolve discrepancies, and objections or comments were invited with a closing date of 3rd March 2023.
The same proposals were advertised on 20th April 2023, with a closing date for comment of 15th May 2023. This time the reason for the changes is cited as being to resolve minor local issues.
The two adverts differ in that “no waiting” provisions were proposed for the road running from Challaborough to Bowling Green Cross in the first version but not in the second.
Please will you provide explanations why:
i) the same proposal has gone to public consultation twice
The same proposal has not been advertised twice.
Devon County Council (Various Streets, Devon) (Waiting Restrictions & Parking Places) Amendment Order (ref 5478) was advertised between 10 February and 3 March 2023. The restrictions proposed were to correct the descriptions within the traffic regulation order for the historic No Waiting restrictions in Challaborough (No Waiting At Any Time on Road from Bowling Green Cross to Challaborough Sea Front and No Waiting Mon-Sat 8am-6pm between 1 May and 30 September on Road from Bigbury Bay Holiday Park to Marwynne).
It is noted that there is an error within the advert and draft order for this TRO that suggested we were proposing No Waiting At Any Time and we apologise for any confusion that may have been caused by this. However, our intention was shown within the plans and supporting documents provided with the traffic order. 5478 SH plans & cover sheet.pdf (pgs 4 & 5)
This traffic order has now been resolved and works are being arranged to bring the historic restriction up to an enforceable standard before the summer break 2023.
Devon County Council (South Hams HATOC) (Traffic Regulation) Amendment Order (ref 6035) is being advertised from 20 April until 22 May 2023. This proposal covers the upgrade of the No Waiting Mon-Sat 8am-6pm between 1 May and 30 September on Road from Bigbury Bay Holiday Park to Marwynne, to No Waiting At Any Time. As this change requires more detailed consultation it was not possible to include it with the first amendment order (ref 5478) and would not have permitted time to introduce enforceable restrictions for Summer 2023. This is why the decision was made to advertise two separate orders, with the intention of implementing the No Waiting At Any Time restriction (double yellow lines) for Summer 2024.
It should be noted that a final decision on TRO 6035 will be made after consideration of any comments submitted during the current consultation.
ii) part of the proposal dated 10th February 2023 had disappeared form the proposal dated 20th April 2023.
The proposal for Road from Bowling Green Cross to Challaborough Sea Front was to reinstate the No Waiting At Any Time as part of the first TRO (ref 5478). This has been agreed and works being arranged. Therefore there was no need to include further changes with the second TRO (ref 6035)
