Sainsbury’s Section 106 Agreement

With regards to the following Section 106 Agreements, Sainsbury’s ref:09/2354/MFUL and Sainsbury’s, ref:09/00558/MA, would you kindly email me details on:

(a) What schemes the S106 financial contributions paid has been expended or allocated for expenditure

(b) The date of expenditure or allocation

(c) How much has been allocated

Ref: 09/2354/MFUL

With regards to questions a,b and c, the Bus revenue contribution was £90,000 plus indexation = £90,902. Two invoices were raised when the triggers were met and were paid on 7th March 2011 and 13th July 2012. The contribution was used to subsidise a bus route in Ottery St Mary . Payments were made to a Bus Company on TRAMS from November 2011 to September 2015.

The S106 obligation to provide £200,000 (indexed linked) contribution for the delivery of a foot and cycle bridge was directed to East Devon District Council (EDDC).

Sainsburys were obligated to pay £10,000 upon commencement of the development towards the improvements to the Hind Street Crossing. A note within our records says the following:

‘Sainsburys supermarkets £10,000 due on commencement of development on land at Hind Street, Ottery St Mary. P/A no. 09/2354/MFUL. To be spent within 7 years of the date of receipt. (Note: £200,000 towards pedestrian/cycle bridge direct to EDDC). No longer expecting £10,000 – Sainsburys to arrange directly.’

(d) How much remains unspent (including any accrued interest).

With regards to ref: 09/2354/MFUL, no contributions for this obligation are due nor received.
