Provision of Footpath – Land on North side & South side of Knighton Rd, Wembury – Planning ref 58/1352/12/F South Hams Council.
The planning Consent for the above had an S106 Agreement to which Devon County Council (DCC) were a Party to. This provided for a new public footpath to be built on land to the South of the development.
The development has been completed and sold for some years now, but as far as we can see the new footpath has not been provided. Therefore, can you please answer the following: –
1. Have the plans for the new footpath been abandoned ?
2. Was Planning Consent ever given for the new Footpath?
3. Was the Footpath Creation Agreement conditioned in the S106 Agreement (that DCC were a party to) ever completed?
4. Has there been any change of Title of the Footpath Land referred to in the S106 Agreement?
