Markham Farm

1. I would like to request all information on what legal documents are in place currently for the promotion of Markham Farm (Owned by Devon County Council), or any co-operation with adjoining landowners?

A previous response was that The Council and the other landowners intend to submit their collaboration agreement with the hearing statement for the Local Plan Examination. This has not been done and the Hearing statements have already been submitted, so I would like an update request on what legal documents are in place for the promotion / co-operation with adjoining landowners with a Collaboration Agreement. If in place, I would like to request a copy of it; and if not in place, please confirm that it is still not in place.

2. What is the tenancy status of Markham Farm in respect of the Break Clase? Previous response was the tenancy is a farm business tenancy as defined in Section 1 Agricultural Tenancies Act 1995. The status is a fixed term tenancy, containing a break clause, and terminating in March 2039. Please advise when the Break Clause is and upon what notice and terms it is exercisable.

We have removed personal information from the updated information. This information is exempt from disclosure under Section 40(2) of the Freedom of Information Act 2000 (Personal Data). The Council cannot disclose personal information if releasing it would contravene any of the provisions in the Data Protection Act 2018. In this instance, release of this information would contravene the first data protection principle and therefore the information is withheld.
