a] The legal basis. In particular was it the Active Travel Statutory Guidance, withdrawn on 2 October 2023?
The legal basis is the Traffic Management Act 2004 and the Road Traffic Regulation Act 1984. The Traffic Management Act is about the Council’s duty to manage the network, including the actions to avoid, eliminate or reduce road congestion (16(2)(b)), and includes consideration for pedestrians and cycles. The Active Travel Statutory Guidance was issued on the back of the Traffic Management Act, and whilst the guidance itself has been withdrawn, the duties within the Traffic Management Act and the original guidance have not. The Road Traffic Regulation Act gives the Council the powers to make the traffic order.
b] the Equality Impact Assessment, in any form and however termed. For the avoidance of doubt this is anything which indicates the likely effects on people with ‘protected characteristics’ under the Equality Act 2010, and preferably showing mitigations offered. This to meet obligations under Sections 20 and 149 of the Act.
