We confirm that information is held which meets the scope of this request. However, it is considered that the disclosure of this information may have the potential to place the Council at increased risk of targeted cyber-crime and as such, is exempt from disclosure under Section 31 (1) of the Freedom of Information Act. The application of this exemption requires a prejudice test and as attacks on IT systems are criminal offences, disclosure might prejudice the prevention of crime by facilitating the possibility of an offence being carried out by encouraging malicious actors.
Section 31 is a qualified exemption which means we are obliged to carry out a public interest test. There is a clear public interest in protecting society from the impact of crime. The greater the potential for a disclosure to result in crime, the greater the public interest in maintaining the exemption. The victims of crime can be both organisations and individuals. We consider that this outweighs any public interest in disclosing the information and therefore believe the application of the exemption is justified.

Anti-virus Software Application – Anti-virus software is a program or set of programs that are designed to prevent, search for, detect, and remove software viruses, and other malicious software like worms, trojans, adware, and more.
The Anti-Virus software in use by Devon County Council is part of the Microsoft Enterprise Agreement and is covered by the contractual details provided in question 3 below. We do not hold separate figures for the anti-virus software as they are part of the suite of products provided under the Enterprise agreement.
