1. How many children in the past 5 years with an acquired brain injury have been turned down for an EHCP?
Devon County Council believes that compliance with this request would exceed the appropriate cost limit under Section 12 of the Freedom of Information Act 2000 which is £450 or 18 hours of officer time. The Council does not collect this information in a reportable format and so to identify if this information is held, would require a review of every individual case from the past 5 years and this would take in excess of 18 hours.
Under the Act, there is a duty to provide advice and assistance about how a request can be refined to fit within the appropriate limit. Unfortunately, because we need to establish if the requested information is held, this is not possible for this request.
2. How long on average does a EHCP take to process for 2022/2023, 2023/24 and 2024/25 to date?
The average timescales are below:
For EHCPs completed in 2024 so far from start to completion the average was 349 days
For EHCPs completed in 2023 from start to completion the average was 321 days
For EHCPs completed in 2022 from start to completion the average was 260 days
This includes plans which have been through the tribunals process.
3. What are the top 3 reasons for turning down a EHCP over the years 2022/23, 2023/24, 2024/25 today?
