Regarding complaints received by Devon County Council, we can advise that compliance with this request would exceed the appropriate cost limit under Section 12 of the Freedom of Information Act 2000 which is £450 or 18 hours of officer time.

We do not record complaints against individual roads and therefore would have to manually review every highways related complaint received to locate and retrieve the information.  A conservative estimate of 5 minutes to review each of the 3700 Highways complaints records for the time period requested to review if any information is held in relation to this and locate and retrieve it would be over 300 hours of work and therefore in excess of the appropriate cost limit. Under the Act, there is a duty to provide advice and assistance as to how a request can be refined to fit within the appropriate limit. Unfortunately, due to the way the data is held, this is not possible for this request.

For public reports please see the attached Enquiries Report. Please note that we only hold information about if the enquiry was from a member of the public, local business or councillor if that information was provided to us at the time. If this information was provided to Devon County Council, this is noted on the details of the enquiry.

For the outcome of identified highways defects please see the Defect Report.

Some of the information has been redacted in grey. This information is exempt from disclosure under Section 40(2) of the Freedom of Information Act 2000 (Personal Data).

The Council cannot disclose personal information if releasing it would contravene any of the provisions in the Data Protection Act 2018. In this instance release of this information would contravene the first data protection principle and therefore the information is withheld.
