1) The expected finish of the application and the advertising notice are 20/12/24. There are 3 phases of work planned, with only the first phase being completed by 20th December. If that is the case, when are the notices being published for the remaining phases and what is the process to raise objections to these works.

Temporary Traffic Regulation Order (TTRO) distributed on the19th July and published in the North Devon Journal (NDJ) between 19th July – 23rd September 2024 and 30th September – 14th October 2024.
Phase 2: 6th January – 7th February 2025 (Water)
TTRO distributed on the 17th July and published in NDJ between the 17th July – 23rd December 2024 and 30th December 2024 – 13th January 2025.
Phase 3: 10th February – 7th March 2025 (Water)
TTRO distributed on the 10th July and published in NDJ between 10th July – 27th January 2025 and 3rd February – 17th February 2025.
Phase 4: 6th January – 28th February 2025 (Electricity)
TTRO distributed on 3rd October and published in NDJ between 3rd October – 23rd December 24 and 30th December 2024 – 13th January 2025.
Southwest Water (SWW) is a Statutory Undertaker of Works under the New Roads & Street Works Act 1991 and there is no avenue to object to the works taking place. The activity is being completed by SWW under the Water Industry Act 1991.
Statutory Undertaker’s have legal rights to lay, maintain and replace apparatus in the highway and have a duty to cooperate with the street authority (Devon County Council) in coordinating their activity which they have done.
2) What were the mitigating circumstances that allowed less than the required minimum 3 month notice period to be given for this work?
TTRO applications should be made with three months’ notice and this has been the case with each application. Processing these within any shorter timescales is at the discretion of the County Council.
