A1.8. Performance management Providers will be required to report on performance through regular returns (e.g. Individualised Learner Records – ILR), qualitative updates, and periodic reviews. The following report will form part of the contract and will be used to assess performance over the lifetime of the agreement. Underperformance may result in corrective action, contract variation, or withdrawal of funding.

2. Suppliers who applied for inclusion on each framework/contract and were successful and not successful at the Pre Qualification Questionnaire and (PQQ) Invitation To Tender (ITT) stages
Information regarding unsuccessful suppliers is exempt from disclosure under Section 43(2) of the Freedom of Information Act 2000 (Commercial Interests).
Devon County Council (DCC) can confirm the requested information is held; however, it’s disclosure would prejudice the commercial interests of the Council. If the tender bid information is released, it undermines all the benefits of a sealed bid process and therefore hinders Devon County Council from achieving best value in the future.
The Council has considered the public interest in releasing this information and recognises there is a public interest in openness and transparency. However, there is a stronger public interest in ensuring DCC achieves best value for money in the future with our ability to negotiate or compete in a commercial environment.
Therefore, the balance of public interest weighs in favour of withholding this information from disclosure.

By way of assistance, the payment for activity follows the DfE funding received whereby for qualifications the income is profiled over the life of the study so those starting later have earned less funding and those with a greater number of guided learning hours carry a greater degree of funding. There are additional DfE factors (e.g co-funded, fully funded, geographical areas of deprivation) that also impact on the funding received per learner.

The start date of the framework is 28 August 2025 and ends of 31 July 2026.
