Section 106

1) The total number of Section 106 agreements between developers and the Council for each financial year since 2010.
2) For the total number of planning obligations agreed under Section 106 since 2010, please provide the number of agreements that fall under each of the following categories:
Delivered in line with S106 and to expectations
Expected to be delivered in full in due course
Delivered but with agreed changes
Not delivered as agreed
Outcome unknown
3) Of the total S106 agreements made between 2010 to present, the number that resulted in a financial payment to the Council instead of a building or construction obligation.
4) Of financial contributions collected under Section 106, how much remains unspent

Compliance with this request would exceed the appropriate cost limit under Section 12 of the Freedom of Information Act 2000 which is £450 or 18 hours of officer time. This request would include agreements we enter into for planning applications that Devon County Council determine, and also any applications Devon County Council signs (as highway/education authority or any other role) that relate to applications determined by the eight district councils as local planning authority. There are an average of 50 S106 agreements per year. It would take at least one hour per agreement to locate, identify and extract the data requested. This would equate to at least 700 hours of work.

Under the Act, there is a duty to provide advice and assistance as to how a request can be refined to fit within the appropriate limit. However, due to the time liaising with the various departments (finance / legal / highways / education etc) to source this information, and the amount of time needed to locate, identify and extract the information from each agreement we are unable to do so in this case.
