Highway Agreements

1. How many S220 bonds are in place?
2a. How many S38/S278 agreements/bonds are in place?
2b. Which developers are they with?
2c. What are the current bond values against each agreement?

Devon County Council considers compliance with this request would exceed the appropriate cost limit under Section 12 of the Freedom of Information Act 2000 which is £450 or 18 hours of officer time. This is because we would need to review hundreds of agreements to locate and extract the requested information and we estimate that it would take a minimum of 20 minutes to review each agreement.

The Freedom of Information Act requires, where possible, for advice and assistance to be offered to support requesters to refine a request so that information can be provided.  Unfortunately, due to the way in which information is held, we are unable to offer such advice in this case.

3. What are your current technical/supervision/inspection fees for agreements?

6% inspection fee for S38 agreements, 7% for S278 agreements.

4. What is your current commuted sum schedule?

We currently collect commuted sums for traffic signals, structures and some drainage features, each decided on a site per site basis. We are in the process of establishing a wider commuted sums policy.
