Planning Obligations

Please note, Devon County Council is only responsible for the administration of S106 agreements in relation to minerals and waste planning applications.

1. How many Section 106 of the Town and Country Planning Act 1990 obligations have been amended, after a development proposal has been accepted?

5. Under S106, how much money should the council have received from developers?

Devon County Council believes compliance with this request would exceed the appropriate costs limit under Section 12 of the Freedom of Information Act 2000. Across all relevant departments there are an average of 60 S106 agreements per year. It would take a minimum of 60 minutes per agreement to locate, identify and extract the data requested. This would equate to at least 240 hours of work, or 60 hours work for the agreements for just one year.

Under Section 16 we are obligated to offer advice and assistant on to how a request may be refined to come in line with the appropriate limit. However, due to the way the information is held, and the amount of time needed to locate, identify and extract it from each agreement we are unable to do so in this case.

6. How much of that money did the council receive?

Devon County Council is joint signatory on S106 agreement in cases where we have asked for financial contributions for education, transportation and waste infrastructure. We hold information on total S106 monies received for the financial year 2019 / 2020 which is £18,250,675.00 and for the financial year 2020/2021 which is £8,821,564.00.
