Information relating to the recent government guidance relating to payment of the national minimum wage in the social care sector and especially relating to “sleep-in” shifts:

However, Devon County Council conducted a review of everyone in receipt of a Sleeping-In Allowance over a 12-month period in 2015 and again in August 2017. All employees were paid more than the National Minimum Wage (NMW) when their normal contractual wage and sleeping-in allowance were averaged.

Devon County Council is compliant with the legal requirement for employees to be paid at least the NMW. We will continue to review the situation and request that the HR Department is contacted should anyone be concerned that an employee is not being paid the NMW.
