Can you please provide me a list of the current open Section 106 and CIL awards for education purposes, which Devon County Council is responsible for. Please indicate for each the value, expiry/discharge date and which of the current open Section 106 and CIL awards have been allocated to a particular project/recipient.
We do not hold a central record of Section 106 awards and we estimate that there are in excess of 100 section 106 awards which are currently open. We would estimate that it would take approximately 20 minutes to review each award to obtain the information requested and, allowing for only 100 awards, this would therefore take a total of more than 33 hours to obtain the information. This is in excess of the appropriate limit of 18 hours and we are therefore not obliged to provide this information pursuant to s.12 of the Freedom of Information Act 2000.
With respect to CIL awards, these are the responsibility of city, district or unitary authorities and we would therefore recommend that you seek this information from these authorities. Contact details can be found on our website at:
