Section 106 Agreements – Values

“Under the Freedom of Information Act, I would like to know the following:-

The total value (in either cash or your best estimate of monetary value) of Section 106 agreements (agreements reached with property developers under Section 106 of the Town and Country Planning Act) reached.

Please provide this data with a year end of 31 March, for each of the following years:
– 1 April 2015 – 31 March 2016
– 1 April 2016 – 31 March 2017
– 1 April 2017 – 31 March 2018
– 1 April 2018 – 31 March 2019
– 1 April 2019 – 31 March 2020

If you cannot provide the data for the last five years, please provide it for the last four years. If you cannot provide the data for the last four years, please provide it for the last three years. If you cannot provide the data for the last three years, please provide it for the last two years. If you cannot provide the data for the last two years, please just provide it for the latest year available.”

We do not hold a central record of Section 106 awards and there are in excess of 80 Section 106 Agreements for the period 1 April 2019 to 31 March 2020.  We would estimate that it would take approximately 20 minutes to review each Agreement to obtain the information requested and, for just the 80 Agreements for the latest financial year, this would take a total of more than 26 hours. This is in excess of the appropriate limit of 18 hours, and we are therefore not obliged to provide this information pursuant to Section 12 of the Freedom of Information Act 2000.
