Energy Performance Certificate (EPC) Enforcement

Request:

“Can you please send me some figures on how many people have been prosecuted in our area only it seems to me that very little has been done on this matter.  When you think it has been law ever since 2007 /2008 very few people seem to know they have to have EPCs in place on sales or rented with new legislation coming in as from April of a minimum level on rented could you please let me know what is happening on the enforcement side of things.”

Response:

Devon County Council (DCC) is not aware of any prosecution being taken in the Devon, Somerset or Torbay areas under this legislation.

As is commonly the case when new legislation is introduced, action was taken at the time, including trade seminars to help businesses familiarise themselves with requirements.

Trading Standards aims to be intelligence led and respond to emerging issues and priorities, and this area has not featured in our programme of work in recent years. This response relates to the Devon County Council Trading Standards Service up to May 2013; the Devon and Somerset Trading Standards Service (hosted by Devon County Council) from May 2013 to May 2017 and the Devon, Somerset and Torbay Trading Standards Service (hosted by Devon County Council) from May 2017 to date, however we have records of predecessor services and no prosecutions are recorded under this legislation.
