In the last financial year 2017/2018 please provide me with the number of settlements and the total amount paid as compensation to teachers or teaching assistants for injuries sustained at schools or outside schools. For each incident please provide me with the amount of compensation, costs and a summary of the claim.
Please clearly indicate any incidents where compensation was made to staff as a result of an injury sustained from an attack by a pupil, or in an incident when trying to restrain a violent pupil.
Note: The question relates to payments made in 2017/2018 regardless of when the incident took place. If the settlement was made by the authority’s insurers it is still information “held” by your authority under the terms of the Act.
Devon County Council only hold information relating to maintained schools; we will not hold information relating to academies or private schools.
In the 2017/18 financial year we can confirm that three settlements were made. The total of these three settlements was £111,795. Other settlements for costs claims were also made.
To disclose the circumstances of each incident, the injury and whether it was sustained from an attack by a pupil would risk identifying the individuals concerned, including the pupils and any other individuals involved in the incident. This would be unfair to the individuals concerned, including the pupils, and a breach of the first data protection principle. This information is therefore exempt from disclosure pursuant to s.40(2) of the Freedom of Information Act 2000.
