3. How many of the requests per quarter have gone over the 20 week timescale from the date the EHC needs assessment is requested to the date the LA issue a final EHC plan?

4. How many in the most recent quarters have gone over the 20 week timescale because of coronavirus? 

The data is not recorded in a way which way which would allow us to put an exact number on this.  Under the Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004 public authorities are not obliged to comply with requests which exceed the cost limit of £450 (equating to 18 hours of time).  For this reason we believe that Section 12 of the Freedom of Information Act applies (cost of compliance exceeds the appropriate limits). 

The number of plans issued on time in Q3 of 2020 has been significantly affected by Coronavirus. The impact on the system of coronavirus was due to:

  • Children being out of school throughout the majority of the assessment period. This meant that education information was limited to inform the provision required.
  • Professionals unable to see children in an education setting. This meant further assessments were planned for September to inform further for which parents wanted the Plan to wait.
  • Responses to schools’ consultations delayed due to children not able to attend schools for visits or interviews and schools and parents waiting until they had the chance to do so.
