Under the Freedom of Information, a copy of the document/documents which formally granted permission (or correspondence acknowledging permission would be incorporated within the scope of the Local Development Order) to excavate Gipsy Lane to lay pipes for the purpose of district heating.
It has now become clear that the consent needed to undertake these works in the highway was not provided by the Local Development Order and no application for a Section 50 licence was made for the works.
Although you state a Section 50 licence has not been granted for this work are you able to under the Freedom of Information Act provide the consultation and feedback comment papers or Minutes, which notified the County Council when this work was to be carried out on the public footpath in Gipsy Lane with HMPE status and if any other regulations i.e. safety regulations etc were imposed by the County Council.
Devon County Council do not hold any consultation and feedback papers or minutes relating to the works.
