In response, items a-b and d-h are exempt from disclosure under Section 21 of the Freedom of Information Act 2000 (Information Reasonably Accessible by Other Means). In addition, item c is exempt from disclosure under Section 22 of the Freedom of Information Act (Information Intended for Future Publication). Devon County Council can confirm the requested information is held but is intended for future publication on the Find a Tender website, this is anticipated to be within the next 3-4 weeks. Given that the publication date is imminent and in line with accepted practices, it is reasonable to withhold this information.
The Council has considered the public interest in releasing this information and recognises there is a public interest in openness and transparency.
The information is scheduled for publication within a short timeframe through an established and publicly accessible publication process. Releasing the information in advance of that planned publication would undermine the consistent dissemination of information and would require the diversion of officer time and resources to facilitate an earlier disclosure outside the intended publication arrangements.
The Council considers that the public interest in accessing the information will be satisfied through the forthcoming publication. Given the imminent publication date and the established mechanism for making the information publicly available, the balance of the public interest favours maintaining the exemption at this time.
