Bovey Basin

I am seeking electronic copies of the following, for ball-clay sites in the Bovey Basin within 5 km of Kingsteignton, covering 1 Jan 2000 to today:

1. The complete ROMP record for each relevant site: applications, determinations, schedules of modern conditions, inspector decisions, dormant-site listings, ‘active’ or ‘dormant’ status decisions, and any subsequent variations.

We have interpreted the ‘complete ROMP record’ as what is held on the planning register as what has been considered and approved for each scheme of working and conditions.

To collate all of the information held would take more than the appropriate time limit of 18 hours, especially as a number of the files are not held electronically and would therefore require review of paper files, and disclosure of the “complete ROMP record” is therefore manifestly unreasonable, pursuant to Part 12 (4) (b) of the Environmental Information Regulations 2004

Nonetheless, by way of assistance, we can provide the following information:

No Prohibition Orders or Cessation Orders exist for these sites.

 

3. Lists or tables maintained by the MPA identifying old mineral permissions in the area with their review status, review dates, and whether modern conditions were imposed.

4. Officer reports, briefing notes, and committee papers that summarise the ROMP outcomes and modern conditions for these sites.

5. For the highway scheme sometimes referenced locally as the ‘new road to Chudleigh’ period circa 2010-2012, please provide relevant planning decision notices, Section 106 or other legal agreements, and any statements by the operator used as justification that referenced long-term reserves or operational life.

We have interpreted your request to refer to current operations. The sites currently working under ‘ROMP’ conditions include:

  • Newbridge – DCC/2704/2008
  • Ringslade – DCC/3493/2013
  • Stover – DCC/4164/2020

All other operational sites in the Bovey Basin are operating under new consents – all of which have previously been provided under EIR request ref: 19559828. These sites no longer operations under the ‘ROMP’ conditions.
