Heavitree and Whipton Active Street Trial

1. Please provide all correspondence between Devon & Cornwall Police, Devon and Somerset Fire and Rescue and South Western Ambulance Service in relation to the current LTN / Active Street Trial for Heavitree and Whipton, as well as all notes and minutes of meetings,

Devon County Council (DCC) are not obliged to provide information that is the personal information of another person if releasing it would contravene any of the provisions in the Data Protection Act 2018.  In this instance we believe that the release of this information would contravene the first data protection principle and therefore Section 40(2) is applied. 

Some information has been withheld under Section 31(1)(a) the prevention or detection of crime. DCC consider the information constitutes valuable intelligence, that could be leveraged to inform a successful attack against our infrastructure.  We feel that releasing this information would therefore increase the chances of DCC becoming the victim of further criminal attacks. We have considered the public interest in releasing this information and whilst we recognise that there is an overriding public interest in openness and transparency, we feel that there is a stronger public interest in the Council maintaining the security and integrity of its infrastructure.  Significant weight should be applied to this public interest consideration given the current situation within the Heavitree and Whipton areas, and the recent vandalism and arson attacks. For these reasons we feel that the balance of public interest weighs in favour of withholding this information from disclosure. 

2. Please provide all correspondence from Highway and Traffic Orders Committees (HATOC) to these three emergency services appertaining to the trial before its inception, during the four options stages.

Devon County Council do not hold any correspondence.

3. Has any assessments or modelling been undertaken to assess impact of response times?

No.

4. How did HATOC conclude they were “broadly in favour” of the trial?

Under Section 21 of the Freedom of Information Act, Devon County Council are not obliged to provide this information as it is already available on our disclosure log and this Democracy Devon webpage.
