Summary of Matter or Issue Requiring Decision:

Early surrender of tenancy at Fairfield Farm, Denbury and subsequent re-letting.

Decision Taken:

Approved that:

  1. Devon County Council accepts the tenant’s short notice of surrender of Fairfield Farm, Denbury, effective at 25 March 2019.
  2. The farmhouse, buildings and 127.81 acres or thereabouts of land at Fairfield Farm, Denbury is to be re-let as an equipped residential dairy holding on the open market to new entrants and on a Farm Business Tenancy commencing 25 March 2019 and expiring 25 March 2026, subject to terms being agreed.
Summary of Reason(s) for Decision Taken:

The tenant of Fairfield Farm, Denbury has requested Devon County Council’s (as the landlord) agreement to terminate the lease early and to vacate the farm.

It is considered to be in the best interests of both landlord and tenant to agree to the early release, enabling the farm to be re-let to a new tenant.

Summary of Alternatives or Options considered and rejected:

To reject the tenant’s request to vacate the farm early would not support the tenant or enable the farm to be relet.
