Privacy notice for Post 16 Learning Participation Team


Devon County Council (DCC) is collecting and or processing your personal data as a Data Controller under United Kingdom General Data Protection Regulations (UK GDPR) and our ICO registration number is Z6475582. This privacy notice concerns the processing of personal data that takes place by the Post 16 Learning Participation Team.

What information are we processing?

We may collect, store or otherwise process information about you which may include:

  • Name
  • Address
  • DOB
  • Telephone number
  • Email address
  • Parent or carer salutation
  • Education and training history

Purpose of collecting or processing your personal data

The law requires all young people in England to continue in education or training until at least their 18th birthday. Local Authorities have broad duties to encourage, enable and assist young people to participate in education or training. This includes the requirement to collect and record information about young people up to and including age 18 and up to age 25 for those with an Education Health and Care Plan (EHCP). The Post 16 Learning Participation Team are employed by Devon County Council (DCC) and undertake this work for DCC and Torbay Council.

DCC process your personal data so that we can:

  • Carry out specific functions for which we are responsible
  • Carry out the Council’s statutory duty under the Education and Skills Act 2008
  • Encourage, enable and assist young people to participate in education or training

The information collected enables the Post 16 Learning Participation Team to identify young people that are Not in Education Employment and Training, and provide careers information advice and guidance to support young people to engage in appropriate Education, Employment or Training opportunities. The collection of the data also enables DCC to deliver it’s statutory duties and improve service provision by targeting areas where there is a need for youth provision.

The legal basis for us collecting your personal data

Where we are collecting personal data about you for the provision of one of the purposes outlined in this privacy notice, we rely upon:

  • Article 6(1)(e) – processing is lawful in performance of a public task

Personal data that is collected for any of the purposes outlined in this notice is never used for direct marketing purposes and is not sold on to any other third parties.

When processing your personal data we will routinely share your personal data with:

  • The Department for Education (DfE)

International transfers

Devon County Council does not intend to transfer personal data to countries that are outside of the scope of UK data protection laws.

How long will we hold your personal data?

Devon County Council will retain your personal data for 7 years from your 18th birthday, or 25th birthday if you have an Education Health and Care Plan (EHCP).

Your data protection rights

Children and young people have the same rights as adults under the UK GDPR. These include:

  1. You have the right to know: You should be told clearly how your personal data is being used.
  2. You have the right to see your data: You can ask for a copy of the personal information held about you.
  3. You have the right to fix mistakes: If your data is wrong or missing something, you can ask for it to be corrected.
  4. You have the right to be forgotten: In some cases, you can ask for your data to be deleted.
  5. You have the right to limit how your data is used: You can ask for your data to be used less or only in certain ways.
  6. You have the right to move your data: You can ask to get your data in a format you can use or send to another service.
  7. You have the right to say no: You can object to your data being used for certain reasons, like marketing.
  8. You have the right to human decisions: You can ask for a real person to review decisions made only by computers if they affect you a lot.
