Full Terms and Conditions


By accepting a grant from Devon County Council (DCC), the applicant organisation agrees to the following terms and conditions. These conditions apply in addition to any specific requirements of the individual grant scheme.

1. Acceptance of the Grant

1.1 The organisation confirms that it is authorised to apply for, accept and manage the grant on behalf of the organisation.

1.2 The organisation confirms that all information provided as part of the application process is accurate, complete and not misleading.

1.3 Acceptance of a grant does not create any entitlement to future funding from Devon County Council.

2. Use of the Grant

2.1 The grant must only be used for the purposes described in the approved application. Any equipment, resources or materials purchased with grant funding must be used primarily for community benefit and for the purposes described in the application.

2.2 The grant must be spent within the timescales specified by Devon County Council or the relevant grant scheme.

2.3 The grant must not be used for any purpose that is unlawful or inconsistent with the aims of the approved project.

2.4 Any significant changes to the project, budget, timescales, activities, outputs or outcomes must be agreed with Devon County Council before they are implemented.

2.5 Any unspent grant funding, or funding no longer required for the approved project, must be returned to Devon County Council if requested.

3. Project Management and Delivery

3.1 The organisation is responsible for the successful delivery of the funded project.

3.2 The organisation must obtain and maintain any licences, permissions, approvals or consents required to deliver the project.

3.3 The organisation must comply with all relevant legislation, regulations and guidance applicable to its activities.

3.4 The organisation must maintain appropriate governance arrangements and financial controls.

3.5 The organisation must notify Devon County Council as soon as reasonably practicable of any significant changes to its governance, legal status, financial position or ability to deliver the project.

3.6 The organisation must maintain appropriate insurance cover relevant to its activities and legal responsibilities and must provide evidence of insurance if requested by Devon County Council.

3.7 Where the project involves working with children, young people or adults at risk, the organisation must have appropriate safeguarding policies and procedures in place and comply with all relevant safeguarding requirements.

4. Monitoring and Reporting

4.1 The organisation must provide information, reports, evidence or feedback requested by Devon County Council relating to the use of the grant and delivery of the project.

4.2 The organisation must co-operate with any reasonable monitoring, evaluation or audit activity undertaken by or on behalf of Devon County Council.

4.3 The organisation must provide a final report, outcome information or other evidence of project delivery if requested.

5. Financial Records and Evidence

5.1 The organisation must keep sufficient financial records, invoices, receipts and other evidence to demonstrate how the grant has been used.

5.2 Devon County Council may request copies of records and evidence demonstrating how grant funding has been spent.

5.3 The organisation must promptly repay any grant funding that has been paid in error.

6. Publicity and Acknowledgement

6.1 Where appropriate, the organisation will acknowledge the support of Devon County Council in publicity, promotional materials and communications relating to the funded project.

6.2 Devon County Council may use information about the project, including outcomes, photographs, videos, case studies and good practice examples, for publicity, reporting and promotional purposes, provided all personal information is handled in accordance with data protection legislation.

6.3 The organisation agrees to co-operate with reasonable requests for project information, photographs, case studies and updates.

7. Data Protection, Freedom of Information and Equalities

7.1 The organisation must comply with all applicable data protection legislation.

7.2 The organisation acknowledges that Devon County Council may be required to disclose information relating to grant applications or awards under the Freedom of Information Act 2000 or Environmental Information Regulations 2004.

7.3 The organisation must comply with relevant equality, diversity, inclusion and human rights legislation and must not unlawfully discriminate.

8. Fraud, Misrepresentation and Conflicts of Interest

8.1 The organisation must take all reasonable steps to prevent fraud, bribery, corruption, financial irregularity and conflicts of interest.

8.2 The organisation must declare any actual, potential or perceived conflict of interest relating to the grant-funded project.

8.3 The organisation must notify Devon County Council immediately if it becomes aware of any fraud, attempted fraud or financial irregularity connected to the project or grant funding.

9. Recovery of Grant Funding

9.1 Devon County Council reserves the right to require repayment of all or part of a grant where:

a) the grant has not been used for the approved purpose;

b) false, misleading or inaccurate information has been provided as part of the application or project;

c) the organisation fails to comply with these terms and conditions;

d) the organisation ceases operations, becomes insolvent or is unable to complete the project;

e) the organisation refuses to provide information reasonably requested by Devon County Council;

f) grant funding remains unspent after the approved project period; or

g) Devon County Council considers that there has been a serious breach of grant conditions.

10. General Conditions

10.1 There is no automatic right to a grant and Devon County Council reserves the right to make funding decisions at its discretion.

10.2 Devon County Council accepts no responsibility for any liabilities, losses, costs or claims arising from the organisation’s activities, delivery of the project or use of the grant.

10.3 Devon County Council may apply additional scheme-specific conditions where required. Any additional conditions will be communicated as part of the application or award process.
