wp-block-group-is-layout-flow\">\n<h2 class=\"wp-block-heading\" id=\"who-needs-an-ehcp\">Who needs an EHC plan?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The majority of children and young people with SEN or disabilities will have their needs met within local mainstream early years settings, schools or colleges (as set out in the information on identification and support in Chapters 5, 6 and 7). Some children and young people may require an EHC needs assessment in order for the local authority to decide whether it is necessary for it to make provision in accordance with an EHC plan. <a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/398815\/SEND_Code_of_Practice_January_2015.pdf\" rel=\"noopener\">SEND Code of Practice 2015:9.1 \u2013 pdf<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Relevant legislation: Section 44 of the Children and Families Act 2014 and Regulations 2, 18, 19, 20, and 21 of the SEND Regulations 2014.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">EHC plans are for children and young people (age 0-25) who have a special educational need or disability that cannot be met by the support that is already available at their school or college Most children and young people with special educational needs will have help given to them without the need for an EHC plan. This is called SEN support. This process starts at the whole school level. Teachers are continually assessing, planning, implementing and reviewing their approach to teaching all children, making adaptations where needed. These small changes and adaptations should be informed by the schools\u2019 <a href=\"https:\/\/www.devon.gov.uk\/support-schools-settings\/ordinarily-available-inclusive-provision\/\">ordinarily available inclusive provision offer<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.devon.gov.uk\/support-schools-settings\/ordinarily-available-inclusive-provision\/targeted\/\">Targeted Support Framework (TSF)<\/a> is designed to support schools and settings to implement a robust graduated approach for children and young people who need support that is \u2018different from or additional to\u2019 ordinarily available inclusive education. It is intended to support all staff, including class teachers, to consider the needs and barriers to learning a child and young person may be experiencing and plan and deliver effective support to meet these needs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"the-devon-early-help-offer\">The Devon Early Help Offer<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.evonscp.org.uk\" rel=\"noopener\">https:\/\/www.evonscp.org.uk<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When a child\/young person\/family needs something extra, Early Help is the initial response offered by all services in contact with children, young people and families. Therefore, please consider if sensitive information should be shared and ensure all information submitted is relevant to the child or young person\u2019s application<\/li>\n\n\n\n<li>Any reports attached to the application should have file names which clearly indicate what they are e.g. (SALT report, Current Attainment)<\/li>\n\n\n\n<li>Any attachments should be in pdf or word formats please do not upload scanned documents or photos of reports as these are hard to read and difficult to use<\/li>\n\n\n\n<li>The assessment process runs throughout the year not just during the academic term, therefore if a submission is made in July you will be expected to make a contribution (or attend a meeting) during the summer holidays<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"completing-the-online-form\">Completing the online form<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The information submitted at this stage will be used to pre-populate your advice if an agreement to assess is made. You will still be asked to submit advice at which point you will be able to edit the information if required.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"consent\">Consent<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Before completing a request you will need to confirm with the consent with the Parent, Carer, Guardian or Young Person (over 16) to the gathering and sharing of information between the child or young person\u2019s educational setting, health services, social care or other professionals \/ organisations as necessary to support the EHC assessment and planning process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You can record any limitations that the above may stipulate in your request.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"details-of-person-requesting-an-ehcp-assessment\">Details of person requesting an EHC assessment<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Include all of your professional details so that you can be contacted by phone, e-mail or post. This is normally within 2 working days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What happens while I\u2019m waiting for an EHC Needs Assessment or Plan?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The child or young person remains on roll at school\/college.<\/li>\n\n\n\n<li>Any alternative provision should be organised by the school.<\/li>\n\n\n\n<li>Schools should continue to:\n<ul class=\"wp-block-list\">\n<li>put in targeted support<\/li>\n\n\n\n<li>work with professionals, e.g. SEN Advisers and Educational Psychologists<\/li>\n\n\n\n<li>implement advice from professionals<\/li>\n\n\n\n<li>follow the Graduated Response and ensure a robust assess, plan, do review cycle is implemented<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>If a part time timetable is agreed, parents must agree and Annexe R must be completed.<\/li>\n\n\n\n<li>Parents are still responsible for their child or young person\u2019s attendance.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"decision-on-whether-to-carry-out-an-ehc-needs-assessment\">Decision on whether to carry out an EHC needs assessment<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Local authorities must give their decision in response to any request for an EHC needs assessment within a maximum of 6 weeks from when the request was received or the point at which a child or young person was brought to the local authority\u2019s attention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We use this <a href=\"https:\/\/www.devon.gov.uk\/education-and-families\/document\/key-facts-education-health-and-care-needs-assessments\/#request-received\">threshold document (Key facts about EHC needs assessment) and guidance<\/a> from the SEND Code of Practice to consider:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the child or young person\u2019s academic attainment and rate of progress<\/li>\n\n\n\n<li>the nature, extent and context of their Special Educational Needs (SEN)<\/li>\n\n\n\n<li>what the school or provider has done to meet the child or young person\u2019s SEN<\/li>\n\n\n\n<li>the child or young person\u2019s physical, emotional and social development and health needs<br>and what has been done to meet these by other agencies<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"access-the-decision\">Access the decision<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If you are unable to see the case when you log in, please make sure you have ticked the option to view closed cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/sway.office.com\/RY6LK3hXvoi8lgEJ?ref=Link\" rel=\"noopener\">Step by step guidance to accessing a decision through the EHC Hub<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the top bar click <strong>decision<\/strong>. You will be notified once the draft plan is available to view. In the meantime, you can view all of the advice contribution on the assessment page.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"draft-plan\">The draft plan<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Following our decision to issue an EHCP, we will prepare a draft version of the plan for the family or young person to view and provide comments on. They will have 15 days to record and submit their comments to us. We will then consider their feedback before issuing the final version of the EHCP.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At this stage, we will also consider the level of funding needed to support the special educational provision described in the EHCP.
