{"id":1209,"date":"2015-05-12T17:17:53","date_gmt":"2015-05-12T16:17:53","guid":{"rendered":"http:\/\/www.devon.gov.uk\/roadsandtransport\/?page_id=1209"},"modified":"2024-10-22T12:44:14","modified_gmt":"2024-10-22T11:44:14","slug":"tree-maintenance","status":"publish","type":"page","link":"https:\/\/www.devon.gov.uk\/roads-and-transport\/maintaining-roads\/trees-and-vegetation-2\/tree-maintenance\/","title":{"rendered":"Tree maintenance"},"content":{"rendered":"\n<p>A tree becomes a hazard when it has a structural defect that may cause the tree, or a portion of the tree, to fall and injure people or damage property.<\/p>\n\n\n\n<p>We inspect and maintain any trees within the highway.<\/p>\n\n\n\n<p>As a landowner or occupier, you need to regularly inspect and maintain any trees on your land that are adjacent to, or within falling distance of, the highway. Where there is a threat to private property, but not the highway, we will only take action if we own the tree.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Things to look out for in an unsafe tree<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Damage<\/h3>\n\n\n\n<p>Look out for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>splits or cracks in the trunk or branches<\/li>\n\n\n\n<li>branches that are broken or hanging<\/li>\n\n\n\n<li>sections of bark damaged or stripped to show the wood beneath &#8211; some trees such as Plane or Eucalyptus naturally shed their bark<\/li>\n\n\n\n<li>soil movement around the base of the tree in strong winds<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Ill health or disease<\/h3>\n\n\n\n<p>Look out for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>sections showing signs of rotting<\/li>\n\n\n\n<li>growth of fungi on the bark, wood or around the base of the tree<\/li>\n\n\n\n<li>foliage dying back or going brown for no apparent reason on evergreen trees, or out of season for deciduous trees<\/li>\n<\/ul>\n\n\n\n<p>More information at <a href=\"https:\/\/www.gov.uk\/government\/collections\/tree-pests-and-diseases\" rel=\"noopener\">GOV.UK: Tree pests and diseases<\/a>.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.devon.gov.uk\/roads-and-transport\/report-a-problem\">Report an unsafe tree adjacent to the highway or a fallen tree or branch on the highway<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Dangerous tree letter or markings<\/h2>\n\n\n\n<p>If you\u2019ve been sent a letter and report about a dangerous tree on your land return the reply slip to us in the envelope provided.<\/p>\n\n\n\n<p>If your tree has been marked with a cross or circle, you will need to phone the number on the notice attached to the tree. If no notice is attached, phone <a href=\"tel:01392385084\">01392 385084<\/a> (option 1).<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A circle means that remedial work is needed, such as removing a branch.<\/li>\n\n\n\n<li>A cross means that the tree has been marked to be felled.<\/li>\n\n\n\n<li>Two circles mean that remedial work is needed immediately.<\/li>\n\n\n\n<li>Two crosses mean that the tree has been identified as imminently dangerous and needs to be felled immediately.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Carrying out work on your tree<\/h2>\n\n\n\n<p>It is good practice to employ <a href=\"http:\/\/www.trees.org.uk\/find-a-professional\/Find-A-Professional\" rel=\"noopener\">a specialist qualified contractor<\/a>&nbsp;to carry out the work. Work on the highway should be carried out safely and by surgeons qualified to work in accordance with the recommendations in <a href=\"https:\/\/www.gov.uk\/government\/publications\/traffic-signs-manual\" rel=\"noopener\">Chapter 8 of the Traffic Signs Manual<\/a>. <\/p>\n\n\n\n<p>The person responsible for the work, or their contractor, should have public liability insurance cover for working on the highway for a value of \u00a35 million. <a href=\"https:\/\/www.devon.gov.uk\/roads-and-transport\/maintaining-roads\/trees-and-vegetation-2\/tree-maintenance\/owners-of-trees-adjacent-to-the-public-highway\/\">Read our information for landowners for more details<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Trees overhanging your property<\/h2>\n\n\n\n<p>It is your common law right to cut back any branches that are overhanging and interfering with your property, as long as your actions don\u2019t affect the health of the tree as a whole. You must check with the <a href=\"http:\/\/local.direct.gov.uk\/LDGRedirect\/MapLocationSearch.do?mode=1.1&amp;map=9-3&amp;auth=93\" rel=\"noopener\">planning department of your district or city council<\/a>&nbsp;before carrying out any work, in case the tree is covered by <a href=\"https:\/\/www.gov.uk\/apply-work-on-protected-tree\" rel=\"noopener\">a tree preservation order<\/a>&nbsp;or is in a conservation area.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Trees preventing light from entering a room<\/h2>\n\n\n\n<p>As a resident, in common law, you don\u2019t have a legal right to light that may be blocked by a Devon County Council tree and we aren\u2019t required to cut back or remove the tree. We only take any action on trees that pose a safety risk to the highway.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Trees growing into wires<\/h2>\n\n\n\n<p>Contact <a href=\"https:\/\/www.openreach.com\/help-and-support\/damage-health-and-safety\" rel=\"noopener\">BT Openreach<\/a>&nbsp;or <a href=\"https:\/\/www.westernpower.co.uk\/contact-us\" rel=\"noopener\">National grid<\/a>&nbsp;about the tree. If the tree is damaging their equipment they will take steps to prevent further damage.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Birds causing a mess on cars<\/h2>\n\n\n\n<p>Although bird droppings are an inconvenience, they are not recognised as a legal nuisance and are not justification for the removal or pruning of a tree.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Devon County Council tree roots damaging property<\/h2>\n\n\n\n<p>If you suspect that the roots of a Devon County Council tree are causing damage to your property, for example, the foundations or private drainage, you must get evidence from both&nbsp;<a href=\"http:\/\/www.trees.org.uk\/find-a-professional\/Find-A-Professional\" rel=\"noopener\">a professional tree surveyor<\/a>&nbsp;and a structural surveyor to verify this.
