Purpose<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This policy sets out how Devon County Council and schools fulfil their responsibilities in relation to permanent exclusion, ensuring that decisions are lawful, fair and proportionate, and that children and young people continue to receive suitable education.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It recognises that suspension and permanent exclusion are legitimate and sometimes necessary tools to maintain safe, calm environments where pupils and staff can work in safety.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It provides a clear framework for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>decision-making in relation to permanent exclusion<\/li>\n\n\n\n<li>supporting children and young people following exclusion<\/li>\n\n\n\n<li>ensuring continuity of education<\/li>\n\n\n\n<li>securing appropriate longer-term provision<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This policy supports a proportionate, inclusive and safeguarding-led approach, ensuring that permanent exclusion is used only where appropriate and that children are supported to access suitable education without unnecessary delay.<\/p>\n\n\n\n<h2 id=\"devons-approach-to-permanent-exclusion\" class=\"wp-block-heading\">2. Devon\u2019s approach to permanent exclusion<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Devon County Council adopts a child-centred, inclusive and needs-led approach to managing permanent exclusions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Permanent exclusion should only be used as a last resort, where a serious breach of behaviour policy has occurred, and allowing the pupil to remain in school would seriously harm the education or welfare of the pupil or others.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wherever possible, schools are expected to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>take early and proportionate action to prevent escalation<\/li>\n\n\n\n<li>implement a graduated response to need<\/li>\n\n\n\n<li>seek to maintain children and young people in their school placement<\/li>\n\n\n\n<li>ensure behaviour strategies and support have been put in place and have not<\/li>\n\n\n\n<li>been successful before considering permanent exclusion<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Where permanent exclusion occurs, Devon County Council will work with schools, families and partners to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ensure continuity of education<\/li>\n\n\n\n<li>support engagement in learning<\/li>\n\n\n\n<li>secure a suitable long-term placement<\/li>\n<\/ul>\n\n\n\n<h3 id=\"2-1-our-approach-in-practice\" class=\"wp-block-heading\">2.1 Our approach in practice<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In delivering the expectations set out in this policy, all partners will apply Devon\u2019s Four Cornerstones. These principles describe how services, schools and professionals should work with children, young people and families in practice.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Welcome and Care &#8211; ensuring children and families feel safe, supported, and able to engage, particularly at times of change, challenge, or vulnerability.<\/li>\n\n\n\n<li>Value and Include &#8211; recognising individual needs, promoting belonging, and removing barriers so all children can access and benefit from education.<\/li>\n\n\n\n<li>Communication &#8211; sharing information clearly, consistently, and transparently, and ensuring that children and families are listened to and understood.<\/li>\n\n\n\n<li>Work in Partnership &#8211; working collaboratively across schools, services, families, and partners to take shared responsibility for outcomes and ensure coordinated support.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These principles underpin how statutory duties and expectations are delivered, ensuring that practice is inclusive, relational, and focused on achieving the best possible outcomes for children and young people.<\/p>\n\n\n\n<h2 id=\"scope\" class=\"wp-block-heading\">3. Scope<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This policy applies to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>all schools in Devon, including maintained schools, academies, free schools and special schools<\/li>\n\n\n\n<li>Devon County Council services with responsibility for education, inclusion, SEND (special educational needs and disabilities), safeguarding, early help and children\u2019s social care<\/li>\n\n\n\n<li>parents and carers of children of compulsory school age whose child may be subject to permanent exclusion<\/li>\n\n\n\n<li>any alternative provision or commissioned education providers involved in supporting children and young people following permanent exclusion<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This policy applies to all children and young people of compulsory school age in Devon who are subject to, or at risk of, permanent exclusion.<\/p>\n\n\n\n<h2 id=\"legal-and-statutory-framework\" class=\"wp-block-heading\">4. Legal and statutory framework<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This policy is underpinned by the following legislation and statutory guidance:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Education Act 2002<\/strong> \u2013 provides the legal framework for the exclusion of pupils, including the powers of headteachers to exclude and the responsibilities of governing bodies to review exclusion decisions and ensure they are lawful, reasonable and fair.<\/li>\n\n\n\n<li><strong>Education Act 1996 (Section 19)<\/strong> \u2013 local authorities to arrange suitable full-time education for pupils who are permanently excluded, from the sixth school day (or from the first day for children in care).<\/li>\n\n\n\n<li><strong>Suspension and permanent exclusion from maintained schools, academies and pupil referral units in England, including pupil movement &#8211; July 2026<\/strong> \u2013 the legal processes that schools and local authorities must follow when excluding a pupil, including decision-making, notification, safeguarding considerations and governing body review arrangements.<\/li>\n\n\n\n<li><strong>Equality Act 2010<\/strong> \u2013 requires schools and local authorities to ensure that exclusion decisions are not discriminatory and that reasonable adjustments are made for pupils with disabilities, including where behaviour is linked to disability.<\/li>\n\n\n\n<li><strong>Children and Families Act 2014<\/strong> \u2013 places duties on schools and local authorities in relation to pupils with SEND, including those with education, health and care plans (EHCPs), which must be considered prior to any exclusion decision.<\/li>\n\n\n\n<li><strong>Keeping Children Safe in Education (KCSIE)<\/strong> \u2013 identifies exclusion as a potential safeguarding indicator and requires that safeguarding considerations are central to all decisions affecting children and young people.<\/li>\n\n\n\n<li><strong>Alternative Provision Statutory Guidance<\/strong> \u2013 sets out expectations for the quality, oversight and planning of education for pupils who are educated outside of mainstream school following exclusion.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Devon County Council will fulfil its responsibilities within this framework through a proportionate, inclusive and safeguarding-led approach, ensuring that permanent exclusion is used appropriately and that children and young people continue to receive suitable education without unnecessary delay.<\/p>\n\n\n\n<h2 id=\"key-definitions\" class=\"wp-block-heading\">5. Key definitions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The following definitions are provided to ensure clarity and consistency in the application of this policy.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Permanent exclusion<\/strong>: The permanent removal of a pupil from a school, resulting in deletion from the school roll.<\/li>\n\n\n\n<li><strong>Suitable education<\/strong>: Education appropriate to the child\u2019s age, ability, aptitude and any special educational needs.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"roles-and-responsibilities\" class=\"wp-block-heading\">6. Roles and responsibilities<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The following responsibilities set out clear expectations for schools, the Local Authority, parents or carers and partners in relation to permanent exclusion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Schools and governing bodies must:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ensure exclusion decisions are lawful, reasonable and fair<\/li>\n\n\n\n<li>use permanent exclusion only as a last resort<\/li>\n\n\n\n<li>follow statutory procedures<\/li>\n\n\n\n<li>provide suitable full-time education for the first five school days<\/li>\n\n\n\n<li>share relevant information promptly with the Local Authority<\/li>\n\n\n\n<li>participate in planning for the pupil\u2019s next steps<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Devon County Council will:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>arrange suitable full-time education from the sixth school day (or day one for<br>children in care)<\/li>\n\n\n\n<li>commission appropriate provision<\/li>\n\n\n\n<li>monitor and review provision<\/li>\n\n\n\n<li>work with schools and partners to secure long-term placements, as soon as possible and practicable<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Parents and carers are expected to:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>engage with the exclusion process<\/li>\n\n\n\n<li>support their child\u2019s access to education<\/li>\n\n\n\n<li>participate in planning and review<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Partners will:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>collaborate with the Local Authority and schools<\/li>\n\n\n\n<li>contribute to assessment and planning<\/li>\n\n\n\n<li>support engagement and transition<\/li>\n<\/ul>\n\n\n\n<h2 id=\"permanent-exclusion-process-and-decision-making\" class=\"wp-block-heading\">7. Permanent exclusion process and decision-making<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Permanent exclusion decisions must be lawful, reasonable, proportionate and procedurally fair.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Decisions should be based on the balance of probabilities, meaning it is more likely than not that the incident occurred.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Permanent exclusion decisions must be supported by clear evidence and a documented rationale demonstrating that the legal threshold has been met.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Schools should be able to evidence the steps taken to support the pupil prior to exclusion and explain why exclusion was necessary and proportionate in the circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Schools must demonstrate that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>appropriate support and intervention has been implemented<\/li>\n\n\n\n<li>exclusion is justified in line with statutory guidance<\/li>\n\n\n\n<li>the child\u2019s needs, including SEND, have been considered<\/li>\n\n\n\n<li>appropriate alternatives, such as managed moves or off-site direction have been considered &#8211; these approaches should be used to support pupils and avoid exclusion where possible, and must not be used as a substitute for formal exclusion procedures<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Where a permanent exclusion occurs:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Devon County Council\u2019s duty to arrange education applies automatically<\/li>\n\n\n\n<li>provision will be arranged without unnecessary delay<\/li>\n\n\n\n<li>the views of the child or young person should be sought and taken into account, considering their age and understanding, and they should be supported to express those views where needed<\/li>\n<\/ul>\n\n\n\n<h2 id=\"expectations-of-provision\" class=\"wp-block-heading\">8. Expectations of provision<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Where a child or young person is permanently excluded, Devon County Council will arrange provision that is suitable, timely and responsive to need.<\/p>\n\n\n\n<h3 id=\"8-1-control-and-commissioning-of-provision\" class=\"wp-block-heading\">8.1 Control and commissioning of provision<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Provision is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>commissioned and arranged by Devon County Council<\/li>\n\n\n\n<li>delivered through approved and quality-assured provision<\/li>\n\n\n\n<li>not determined by parents or schools<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Decisions about provision rest with the Local Authority.<\/p>\n\n\n\n<h3 id=\"8-2-nature-and-quality-of-provision\" class=\"wp-block-heading\">8.2 Nature and quality of provision<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Provision will:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>be appropriate to the child or young person\u2019s age, ability, aptitude and any special educational needs<\/li>\n\n\n\n<li>be full-time wherever possible<\/li>\n\n\n\n<li>be arranged and delivered without unnecessary delay, having regard to statutory timescales<\/li>\n\n\n\n<li>support engagement and progress<\/li>\n<\/ul>\n\n\n\n<h3 id=\"8-3-duration-and-outcomes\" class=\"wp-block-heading\">8.3 Duration and outcomes<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Provision will be:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>subject to regular review to assess engagement, attendance, progress and ongoing suitability<\/li>\n\n\n\n<li>planned and delivered with a clear focus on securing a suitable and sustainable long-term placement<\/li>\n<\/ul>\n\n\n\n<h2 id=\"vulnerable-groups-and-additional-considerations\" class=\"wp-block-heading\">9. Vulnerable groups and additional considerations<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Devon County Council recognises that some children and young people may be more vulnerable to the impact of permanent exclusion. Decisions relating to permanent exclusion must give full and careful consideration to these groups.<\/p>\n\n\n\n<h3 id=\"9-1-children-in-our-care-and-children-with-a-social-worker\" class=\"wp-block-heading\">9.1 Children in our care and children with a social worker<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Children in care and children with a social worker are particularly vulnerable to the impact of exclusion. These children are more likely to have experienced adversity, disruption and unmet need, and exclusion can have a profound and lasting impact on their life chances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As Corporate Parent, Devon County Council has a clear responsibility to promote the educational achievement, stability and wellbeing of children in care. Permanent exclusion of a child in care should therefore be avoided wherever possible and must only occur in the most exceptional circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, for children with a social worker, schools and partners must recognise the heightened safeguarding risks and the importance of maintaining educational engagement and stability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before proceeding with a permanent exclusion, schools must:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>take all reasonable steps to prevent exclusion<\/li>\n\n\n\n<li>work closely with Devon Virtual School<\/li>\n\n\n\n<li>seek advice and support at the earliest opportunity<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Schools must contact the Virtual School Head or their representative before proceeding with a permanent exclusion, except in the most exceptional circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Devon County Council will give particular scrutiny to any exclusion involving a child in care to ensure that the decision is lawful, proportionate and that all appropriate support has been considered.<\/p>\n\n\n\n<h3 id=\"9-2-children-with-send\" class=\"wp-block-heading\">9.2 Children with SEND<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Devon County Council recognises that children with SEND, including those with EHCPs, are disproportionately affected by permanent exclusion. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These children may have unmet or under-identified needs, and exclusion can significantly undermine their educational progress, wellbeing and long-term outcomes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Permanent exclusion must not be used as a response to unmet need, or where<br>appropriate support, intervention and reasonable adjustments have not been fully<br>implemented.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before proceeding with a permanent exclusion, schools must:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ensure that all appropriate support and reasonable adjustments have been implemented<\/li>\n\n\n\n<li>consider whether behaviour may be linked to unmet special educational needs<\/li>\n\n\n\n<li>engage with Devon County Council Education Quality and Inclusion teams at an early stage<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Where a child or young person has an EHCP:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Devon County Council will continue to secure the provision specified in the EHCP<\/li>\n\n\n\n<li>decisions must take full account of the child or young person\u2019s identified needs<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">An emergency or early review of the EHCP should be considered where the current placement may not be meeting the child\u2019s needs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Permanent exclusion must not be used as a long-term response to unmet special educational needs.<\/p>\n\n\n\n<h2 id=\"safeguarding\" class=\"wp-block-heading\">10. Safeguarding<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Devon County Council is committed to safeguarding and promoting welfare. Children who are excluded may be more vulnerable. Safeguarding must remain a central consideration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Devon County Council will:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ensure safeguarding informs all decisions<\/li>\n\n\n\n<li>share information with relevant agencies<\/li>\n\n\n\n<li>take immediate action where concerns arise<\/li>\n<\/ul>\n\n\n\n<h2 id=\"11-related-policies\" class=\"wp-block-heading\">11.
