summary of conditions<\/a><ul><li class=\"\"><a href=\"#mandatory-conditions\">Mandatory conditions<\/a><\/li><li class=\"\"><a href=\"#discretionary-conditions\">Discretionary conditions<\/a><\/li><\/ul><\/li><\/ul><\/nav><\/div>\n\n\n<\/aside>\n\n\n\t<div class=\"dcc-documents-cpt-fixed dccdocs-sticky dccdocs-hidden\">\r\n    <div class=\"grid-container\">\r\n        <div class=\"grid-x grid-margin-x\">\r\n            <div class=\"cell medium-12\">\r\n                <a class=\"back-to-top hide-for-print\" href=\"#content\"><svg class=\"app-c-back-to-top__icon\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" width=\"13\" height=\"17\" viewBox=\"0 0 13 17\"><path fill=\"currentColor\" d=\"M6.5 0L0 6.5 1.4 8l4-4v12.7h2V4l4.3 4L13 6.4z\"><\/path><\/svg> Contents<\/a>\r\n            <\/div>\r\n        <\/div>\r\n    <\/div>\r\n\t<\/div>\r\n<\/div>\n\n\n\n<div class=\"wp-block-column doc-content is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:75%\">\n<div class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<h2 class=\"wp-block-heading\" id=\"agreement\">Agreement<\/h2>\n\n\n\n<p>This agreement is between the person receiving the <strong>direct payment<\/strong> (<strong>you<\/strong>) who will be either the<br><strong>recipient or the representative of the recipient<\/strong> and Devon County Council (<strong>we or us<\/strong>).<br><\/p>\n\n\n\n<p><strong>In these terms and conditions:<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"definitions\">Definitions<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Contingency arrangements<\/strong> means the plan <strong>you<\/strong> have in place to provide the care and support in emergencies, for example, if <strong>your<\/strong> personal assistant is off sick.<\/li>\n\n\n\n<li><strong>Contribution<\/strong> means the amount the <strong>recipient<\/strong> must contribute to their personal budget.<\/li>\n\n\n\n<li><strong>Devon Card<\/strong> means the prepaid visa debit card on which <strong>we<\/strong> will make the <strong>direct payment<\/strong><em> <\/em>unless <strong>we<\/strong> have agreed you can use a separate bank account.<\/li>\n\n\n\n<li><strong>Direct payment<\/strong> is the way you have chosen to receive the <strong>personal budget <\/strong>to enable <strong>you <\/strong>to arrange and buy social care support.<\/li>\n\n\n\n<li><strong>Employers&#8217; liability insurance<\/strong> means the compulsory insurance that employers are required to have in place against personal injury to their employees.<\/li>\n\n\n\n<li><strong>Personal assistant (PA)<\/strong> means an individual support worker who works on a one-to-one basis and who is not separately employed by any agency or other employer.<\/li>\n\n\n\n<li><strong>Personal budget<\/strong> means the total sum of money that <strong>we<\/strong> have assessed the <strong>recipient<\/strong> as being entitled to receive to meet their social care needs following a social care needs assessment.<\/li>\n\n\n\n<li><strong>Recipient<\/strong> means the person for whom the <strong>direct payment<\/strong> is being made.<\/li>\n\n\n\n<li><strong>Representative<\/strong> means a person signing this agreement on the <strong>recipient\u2019s<\/strong> behalf.<\/li>\n\n\n\n<li><strong>Support plan<\/strong> means the care and support plan agreed by <strong>you<\/strong> or the <strong>recipient<\/strong> (or both) to meet the assessed care and support needs of the <strong>recipient<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"1-identification-check\">1: Identification check<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>1.1 Before <strong>we<\/strong> can make a <strong>direct payment<\/strong> to <strong>you<\/strong>, <strong>we<\/strong> need to verify<strong> your<\/strong> identity<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>1.2 When <strong>you<\/strong> sign this agreement and tick the check box at the back,<em> <\/em><strong>you<\/strong> are consenting to <strong>us<\/strong> providing <strong>your<\/strong> name, address and date of birth to <strong>our<\/strong> contracted identity provider, Experian, who will undertake a secure identity check on <strong>our<\/strong> behalf. This will be a soft enquiry which will not appear on <strong>your<\/strong> credit report and will not impact <strong>your<\/strong> credit score. <strong>We<\/strong> will be unable to make a <strong>direct payment<\/strong> to <strong>you<\/strong> unless this check is carried out.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"2-amount-of-the-direct-payment\">2: Amount of the direct payment<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>2.1 <strong>We<\/strong> have agreed to pay <strong>you<\/strong> the <strong>personal budget<\/strong> amount detailed in the <strong>support plan <\/strong>by way of a <strong>direct payment<\/strong>.<\/li>\n\n\n\n<li>2.2 Recurring payments will be made every 4 weeks in advance.<\/li>\n\n\n\n<li>2.3 Unless <strong>you<\/strong> are funded by Torbay and South Devon NHS Trust, <strong>we<\/strong> will undertake a financial assessment and inform <strong>you<\/strong> of any <strong>contribution<\/strong> you are required to make.<\/li>\n\n\n\n<li>2.4 Where you receive the <strong>direct payment<\/strong> onto the <strong>Devon Card<\/strong>, <strong>we<\/strong> will invoice <strong>you<\/strong> for any required <strong>contribution<\/strong> and <strong>you<\/strong> must pay this to <strong>us<\/strong> by the date in the invoice.<\/li>\n\n\n\n<li>2.5 Where <strong>we<\/strong> have consented to <strong>you<\/strong> having a separate bank account, any required <strong>contribution<\/strong> must be paid into this bank account. <strong>Your contribution<\/strong> will make up the first part of <strong>your<\/strong> <strong>personal budget<\/strong> and will therefore be spent first. For further information please refer to the <strong>Service User\u2019s Guide<\/strong> (See the link at<a href=\"https:\/\/www.devon.gov.uk\/adult-social-care\/document\/direct-payment-agreement-terms-and-conditions\/#appendix-a-links-to-useful-information-on-direct-payments\"> Appendix A<\/a>).<\/li>\n\n\n\n<li>2.6 <strong>We<\/strong> may adjust the amount of <strong>direct payment<\/strong> in April of each year to allow for inflation. <strong>We<\/strong> will write to confirm any changes.<\/li>\n\n\n\n<li>2.7 <strong>We<\/strong> may also adjust the amount of <strong>direct payment<\/strong> if there are direct legislation changes (for example, changes to the minimum wage or to holiday entitlement) that affect the terms and conditions of employment of anyone <strong>you<\/strong> have employed as a consequence of this agreement. <strong>We<\/strong> will write to confirm any changes.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"3-direct-payment-devon-card\">3: Direct payment &#8211; Devon Card<\/h2>\n\n\n\n<p>This clause only applies if <strong>you<\/strong> are receiving the <strong>direct payment<\/strong> via the <strong>Devon Card<\/strong>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>3.1 Unless otherwise agreed with <strong>us<\/strong>, <strong>we<\/strong> will pay the <strong>direct payment<\/strong> onto the <strong>Devon Card<\/strong>. The <strong>Devon Card<\/strong> is a safe and efficient way to pay for services and includes the ability to make bank transfers, set up standing orders and direct debits, and utilise telephone and online banking.<\/li>\n\n\n\n<li>3.2 Our provider will supply the <strong>Devon Card<\/strong> to <strong>you<\/strong> at no cost together with a user guide explaining how it works.<\/li>\n\n\n\n<li>3.3 <strong>You<\/strong> must use the <strong>Devon Card<\/strong> for all purchases made with the <strong>direct payment<\/strong>.<\/li>\n\n\n\n<li>3.4 <strong>We<\/strong> will monitor the transactions <strong>you<\/strong> make on the <strong>Devon Card<\/strong> to manage compliance and protect against fraud.<\/li>\n\n\n\n<li>3.5 <strong>You<\/strong> must keep a clear record for seven years (for example, invoices, payslips, HMRC records) and all receipts for payments made and will supply them to <strong>us<\/strong> upon request. Failure to provide adequate records for the purchases made may result in <strong>us<\/strong> ending this agreement.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"4-direct-payment-separate-bank-account\">4: Direct Payment &#8211; separate bank account<\/h2>\n\n\n\n<p>This clause only applies if <strong>we<\/strong> have agreed that <strong>you<\/strong> can receive the <strong>direct payment<\/strong> into a separate bank account.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>4.1 <strong>We<\/strong> will monitor the transactions <strong>you<\/strong> make to manage compliance and protect against fraud.<\/li>\n\n\n\n<li>4.2 <strong>You<\/strong> must keep a clear record for seven years (e.g. bank statements, invoices, payslips, HMRC records) and all receipts for payments made and will supply them to <strong>us<\/strong> upon request. Failure to provide adequate records for the purchases made may result in <strong>us <\/strong>ending this agreement.<\/li>\n\n\n\n<li>4.3 <strong>You<\/strong> must send bank statements and the money tracker form to <strong>our<\/strong> finance team at the intervals requested by <strong>us<\/strong> for account monitoring purposes.<\/li>\n\n\n\n<li>4.4 If you have problems managing <strong>your<\/strong> separate bank account or if adequate returns are not provided in a timely manner, <strong>you<\/strong> may be required to transfer the <strong>direct payment<\/strong> to the <strong>Devon Card<\/strong> or, alternatively, <strong>we<\/strong> may revert to providing <strong>you<\/strong> with a commissioned service<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"5-using-your-direct-payment\">5: Using your direct payment<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>5.1 The <strong>direct payment<\/strong> must only be used to meet the outcomes set out in the <strong>support plan<\/strong>. <strong>You<\/strong> must not spend it on something different or <strong>you<\/strong> will be in breach of this agreement which may result in <strong>us<\/strong> ending it and\/or taking action to recover funds<strong>.<\/strong><\/li>\n\n\n\n<li>5.2 Further details of what <strong>you<\/strong> are permitted to purchase with the <strong>direct payment<\/strong> are set out in Appendix 1 to our<strong> Self-Directed Support Policy (direct payments)<\/strong> (See the link at <a href=\"https:\/\/www.devon.gov.uk\/adult-social-care\/document\/direct-payment-agreement-terms-and-conditions\/#appendix-a-links-to-useful-information-on-direct-payments\">Appendix A<\/a>).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"6-paying-family-members\">6: Paying family members<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>6.1 <strong>You<\/strong> must not use the <strong>direct payment <\/strong>to pay a close family member who lives with the <strong>recipient<\/strong> without <strong>our<\/strong> prior written consent. This will only be provided where <strong>we<\/strong> consider that it is necessary to do so.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"7-service-arrangements-and-support-providers\">7: Service arrangements and support providers<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>7.1 <strong>You <\/strong>are responsible for managing all arrangements for service provision to meet the outcomes specified in the <strong>support plan<\/strong>. This will include putting in place <strong>contingency arrangements<\/strong> for any break in service.<\/li>\n\n\n\n<li>7.2 If there is a break in service and the <strong>contingency arrangements<\/strong> fail, <strong>we<\/strong> must be informed and <strong>we<\/strong> will try to arrange alternative services. <strong>We<\/strong> will recover monies and detail the amount in writing.<\/li>\n\n\n\n<li>7.3 <strong>You<\/strong> should carry out checks on the safety and quality of the services <strong>you<\/strong> are proposing to put in place. (See the link at <a href=\"https:\/\/www.devon.gov.uk\/adult-social-care\/document\/direct-payment-agreement-terms-and-conditions\/#appendix-a-links-to-useful-information-on-direct-payments\">Appendix A<\/a> &#8211; Arranging Care and Support Safely).<\/li>\n\n\n\n<li>7.4 <strong>We<\/strong> intend that the <strong>direct payment<\/strong> is the means by which <strong>you<\/strong> are able to independently arrange and manage the services required to meet the outcomes as set out in the <strong>support plan<\/strong>. However, where there is evidence to suggest that the person or organisation providing a service is unfit, not able to provide an adequate or appropriate service or is not meeting the principles of <strong>our<\/strong> <strong>Fair and Affordable Care policy<\/strong> (See the link at<a href=\"https:\/\/www.devon.gov.uk\/adult-social-care\/document\/direct-payment-agreement-terms-and-conditions\/#appendix-a-links-to-useful-information-on-direct-payments\"> Appendix A<\/a>), <strong>we<\/strong> may require <strong>you<\/strong> to change the service provider.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"care-agency\"><strong>Care agency<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>7.5 <strong>You<\/strong> must ensure that any agency that <strong>you<\/strong> purchase regulated care services from is registered with the <a href=\"https:\/\/www.cqc.org.uk\/\" rel=\"noopener\">Care Quality Commission (CQC)<\/a> in respect of that activity. Regulated care is any form of personal care service in the person\u2019s own home and it is an offence for any commercial provider to offer such personal care without a CQC registration.<\/li>\n\n\n\n<li>7.6 <strong>We<\/strong> strongly recommend that <strong>you<\/strong> have a written contract in place with any care agency that is used for providing care and support.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"personal-assistants-p-as\">Personal assistants (PAs)<\/h3>\n\n\n\n<p><strong>General requirements<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>7.7 <strong>We<\/strong> have a PA network where <strong>you<\/strong> can find useful information about employing a personal assistant (See the link as <a href=\"https:\/\/www.devon.gov.uk\/adult-social-care\/document\/direct-payment-agreement-terms-and-conditions\/#appendix-a-links-to-useful-information-on-direct-payments\">Appendix A<\/a>).<\/li>\n\n\n\n<li>7.8 Please also refer to the <strong>employing a personal assistant FAQ<\/strong> for further information on the factors <strong>you<\/strong> must take into account (See the link at <a href=\"https:\/\/www.devon.gov.uk\/adult-social-care\/document\/direct-payment-agreement-terms-and-conditions\/#appendix-a-links-to-useful-information-on-direct-payments\">Appendix A<\/a>).<\/li>\n\n\n\n<li>7.9 If <strong>you<\/strong> are planning to use a <strong>PA<\/strong> to provide care, <strong>we<\/strong> strongly recommend that <strong>you<\/strong> check their employment history by obtaining a minimum of two references, asking to see proof of their training and qualifications and their right to work in the UK. <strong>You<\/strong> should also check their employment status by referring to <a href=\"https:\/\/www.gov.uk\/guidance\/check-employment-status-for-tax\" rel=\"noopener\">HMRC\u2019s Employment Status Guidance and Calculator<\/a>.<\/li>\n\n\n\n<li>7.10 <strong>You<\/strong> must purchase and maintain adequate <strong>employers&#8217; liability insurance<\/strong>. The costs of such insurance will be included within the <strong>personal budget<\/strong>. <strong>You<\/strong> must provide <strong>us<\/strong> with a copy of this insurance and receipts for payment upon request.<\/li>\n\n\n\n<li>7.11 <strong>We<\/strong> recommend that <strong>you<\/strong> carry out a Disclosure and Barring Service (DBS) check. If<strong> you<\/strong> request, <strong>your <\/strong>arranging support adviser can arrange for this check to be completed for <strong>you<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p><strong>Employing a PA<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>7..12 <strong>You<\/strong> must comply with all legal duties and obligations as an employer including those required by HM Revenues and Customs (HMRC) and the UK Border Agency.<\/li>\n\n\n\n<li>7.13 Anyone employed through a <strong>direct payment<\/strong> will not be considered our employee or agent and <strong>we<\/strong> will not be responsible for income tax, national insurance or any other employee payments or legal responsibilities in relation to employees. These will be <strong>your<\/strong> sole responsibility.<\/li>\n\n\n\n<li>7.14 <strong>You<\/strong> must put a contract of employment in place with the <strong>PA<\/strong> which includes terms and conditions i.e. agreed holiday, sick pay, working hours. Please refer to the <a href=\"https:\/\/www.devon.gov.uk\/adult-social-care\/document\/direct-payment-agreement-terms-and-conditions\/#appendix-a-links-to-useful-information-on-direct-payments\">Appendix A<\/a> \u2013 Skills for Care website for further information.<\/li>\n\n\n\n<li>7.15 <strong>You<\/strong> must use a payroll advice service or equivalent to ensure that wages, income tax, national insurance, holiday and pension contributions and any other required payment are complied with. The costs of this will be included in <strong>your personal budget<\/strong>.<\/li>\n\n\n\n<li>7.16 <strong>You<\/strong> must ensure that <strong>employers&#8217; liability insurance<\/strong> is in place and <strong>public liability insurance<\/strong> if required.<\/li>\n\n\n\n<li>7.17 <strong>You<\/strong> must ensure the PA is paid at a rate that is not less than the National Minimum Wage.<\/li>\n<\/ul>\n\n\n\n<p><strong>Self-employed PA<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>7.18 If a PA maintains that they are self-employed, we strongly recommend that you carry out all relevant checks with HMRC, this may include obtaining a Unique Taxpayer Reference number (UTR) that verifies self-employed status. Please refer to <a href=\"https:\/\/www.gov.uk\/guidance\/check-employment-status-for-tax\" rel=\"noopener\">government guidance on how to check employment status for tax<\/a>. We acknowledge there may be some exemptions, however you will need to be reassured these apply in your specific circumstances. Failure to do so may leave you liable for tax and pension contributions plus penalties.<\/li>\n\n\n\n<li>7.19 <strong>You<\/strong> must also obtain proof that they have required public liability insurance in place.<\/li>\n\n\n\n<li>7.20 <strong>You<\/strong> must put a services agreement\/written statement of work in place with the <strong>PA<\/strong> which should, amongst other things, set out their employment status, their charges, when they will work for <strong>you<\/strong>. Please refer to the <a href=\"https:\/\/www.devon.gov.uk\/adult-social-care\/document\/direct-payment-agreement-terms-and-conditions\/#appendix-a-links-to-useful-information-on-direct-payments\">Appendix A<\/a> \u2013 Skills for Care website for further information.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"8-help-managing-a-direct-payment\">8: Help managing a direct payment<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>8.1 Please refer to the <a href=\"https:\/\/www.devon.gov.uk\/adult-social-care\/document\/direct-payment-agreement-terms-and-conditions\/#appendix-a-links-to-useful-information-on-direct-payments\">Appendix A<\/a> for further information about where <strong>you<\/strong> can obtain support and advice on managing the <strong>direct payment<\/strong>.<\/li>\n\n\n\n<li>8.2 <strong>Our<\/strong> Arranging Support Team will provide initial support to new <strong>direct payment<\/strong> recipients. If after three months, <strong>you<\/strong> are still unable to manage independently, the <strong>recipient<\/strong> may be provided with commissioned services instead of a <strong>direct payment<\/strong>.<\/li>\n\n\n\n<li>8.3 <strong>We<\/strong> will provide funding for ongoing financial support services where this is agreed in the <strong>support plan<\/strong> for example, payroll services.<\/li>\n\n\n\n<li>8.4 <strong>We<\/strong> have a service level agreement with Disability Focus who can provide <strong>you<\/strong> with financial administrative support. Please see <a href=\"https:\/\/www.devon.gov.uk\/adult-social-care\/document\/direct-payment-agreement-terms-and-conditions\/#appendix-b-disability-focus-financial-administration-services\">Appendix B<\/a>. If <strong>you<\/strong> receive support from Disability Focus, it is important to keep them up to date with any changes to <strong>your<\/strong> employee arrangements (for example sickness, holiday, employment ending). If they are not kept informed, an overpayment may occur for which <strong>you<\/strong> will be responsible.<\/li>\n\n\n\n<li>8.5 Despite any support that is put in place, <strong>you<\/strong> are responsible for the <strong>direct payment<\/strong> and the care and support arrangements. If at any point <strong>you<\/strong> do not wish to continue receiving a <strong>direct payment<\/strong>, <strong>you<\/strong> should inform <strong>us<\/strong> immediately and <strong>we<\/strong> will arrange for a commissioned service to be put in place.<\/li>\n\n\n\n<li>8.6 If <strong>you<\/strong> are experiencing difficulty managing the <strong>direct payment<\/strong> <strong>you<\/strong> should contact: Care Direct Plus East on <a href=\"tel:01392381206\" data-type=\"link\" data-id=\"Tel:01392381206\">01392 381206<\/a> option 1, then option 1 or <a href=\"mailto:csc.caredirect@devon.gov.uk\">csc.caredirect@devon.gov.uk<\/a>, alternatively, <strong>you<\/strong> can email the Arranging Support Team directly at: <a href=\"mailto:ASTSelfdirectedsupporteast@devon.gov.uk\">ASTSelfdirectedsupporteast@devon.gov.uk<\/a> or <a href=\"mailto:ASTSelfdirectedsupportsouth@devon.gov.uk\">ASTSelfdirectedsupportsouth@devon.gov.uk<\/a> or <a href=\"mailto:ASTSelfdirectedsupportnorth@devon.gov.uk\">ASTSelfdirectedsupportnorth@devon.gov.uk<\/a><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"9-change-of-circumstances\">9: Change of circumstances<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>9.1 <strong>You<\/strong> must inform <strong>us<\/strong> as soon as possible if there is any change in <strong>your or the<\/strong> <strong>recipient\u2019s<\/strong> financial or other circumstances which may affect the amount of <strong>personal budget<\/strong> or the care and support needed for example, if the <strong>recipient<\/strong> goes into hospital.<\/li>\n\n\n\n<li>9.2 Where there is a temporary change in circumstances, <strong>we<\/strong> may decide to suspend payment. Any decision to suspend payment will take account of any reasonable existing liabilities including periods of notice relating to the service arrangements. <strong>You<\/strong> will be notified in writing of any such changes.<\/li>\n\n\n\n<li>9.3 <strong>You<\/strong> must advise <strong>us<\/strong> if there is any change to <strong>your<\/strong> contact information as completed at the end of this agreement.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"10-what-will-happen-in-the-event-of-your-death\">10: What will happen in the event of your death<\/h2>\n\n\n\n<p><strong>Devon Card<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>10.1 Any funds left on the <strong>Devon Card<\/strong> will not form part of the <strong>recipient\u2019s<\/strong> estate and will be recovered by <strong>us<\/strong> after relevant discussions.<\/li>\n<\/ul>\n\n\n\n<p><strong>Bank account<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>10.2 Any remaining funds in the bank account will not form part of <strong>your<\/strong> estate and must be returned to <strong>us<\/strong> immediately.<\/li>\n\n\n\n<li>10.3 <strong>We<\/strong> will pay any amount due to the <strong>recipient\u2019s<\/strong> estate to fulfil any contractual or legal obligations due on receipt of supporting documentation or an invoice.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"11-review-of-direct-payments\">11: Review of direct payments<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>11.1 <strong>We<\/strong> will review the management of the <strong>direct payment<\/strong> as part of the initial review of <strong>your support plan<\/strong> and annually thereafter to check that the <strong>direct payment<\/strong> is still an appropriate way to meet the <strong>recipient\u2019s<\/strong> needs.<\/li>\n\n\n\n<li>11.2 <strong>We<\/strong> will check that <strong>you<\/strong> are complying with <strong>your<\/strong> employer obligations, if applicable, including PAYE returns, paying tax and national insurance deductions to HMRC and have the required <strong>employers&#8217; liability insurance<\/strong> in place.<\/li>\n\n\n\n<li>11.3 <strong>We<\/strong> will provide reasonable notice of the review and <strong>you<\/strong> are responsible for engaging with the review process and for taking all reasonable steps to provide any information and evidence that <strong>we<\/strong> request.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"12-review-of-support-needs\">12: Review of support needs<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>12.1 <strong>We<\/strong> will undertake an annual review of the <strong>support plan<\/strong>.<\/li>\n\n\n\n<li>12.2 A review will also be triggered if the monitoring and review of the <strong>direct payment <\/strong>raises concerns about whether the <strong>recipient\u2019s<\/strong> support needs are being met.<\/li>\n\n\n\n<li>12.3 If there is a change in needs, this may result in a change to the <strong>personal budget<\/strong>. <strong>We<\/strong> will notify <strong>you<\/strong> in writing of any such changes.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"13-surplus-funds\">13: Surplus funds<\/h2>\n\n\n\n<p><strong>Devon Card<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>13.1 If a surplus of funds has accumulated on the <strong>Devon Card<\/strong>, <strong>we<\/strong> will seek to reclaim any surplus where the amount in <strong>your<\/strong> account exceeds 8 weeks\u2019 of your personal budget. If <strong>your<\/strong> individual circumstances may mean <strong>you<\/strong> need more than the 8 weeks balance, you must contact <strong>us<\/strong> to discuss an exception.<\/li>\n\n\n\n<li>13.2 Any surplus funds on the <strong>Devon Card<\/strong> remain <strong>our<\/strong> property.<\/li>\n<\/ul>\n\n\n\n<p><strong>Bank account<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>13.3 If a surplus of funds has accumulated in <strong>your<\/strong> bank account, considering the need for contingency and any other anticipated expenditure, the surplus must be repaid to <strong>us<\/strong>. Any surplus identified and requested for repayment, will be automatically recovered, unless <strong>you<\/strong> contact <strong>us<\/strong> to request that <strong>we<\/strong> leave it in <strong>your<\/strong> account. Failure to do so may result in <strong>us<\/strong> taking legal action against <strong>you<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"14-when-will-we-claim-money-back\">14: When will we claim money back?<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>14.1 <strong>We<\/strong> may recover any <strong>direct payment<\/strong> money from <strong>you<\/strong> which is not used in accordance with this agreement or to meet the agreed outcomes as set out in the <strong>support plan<\/strong>. <strong>We<\/strong> will routinely reclaim surplus where the amount in <strong>your<\/strong> account exceeds 8 weeks\u2019 of <strong>your<\/strong> personal budget.<\/li>\n\n\n\n<li>14.2 Where a misspend has occurred but is the result of a genuine mistake, <strong>we<\/strong> will liaise with <strong>you<\/strong> to arrange a voluntary repayment.<\/li>\n\n\n\n<li>14.3 Where a misspend has occurred and is as a result of a deliberate breach or any of the conditions of this agreement, repayment will be requested.<\/li>\n\n\n\n<li>14.4 Failure to repay any misspent funds may result in <strong>us<\/strong> taking legal action against <strong>you<\/strong> in the County Court as well as the termination of the <strong>direct payment<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"15-ending-this-agreement\">15: Ending this agreement<\/h2>\n\n\n\n<p><strong>You<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>15.1 <strong>You<\/strong> can end this agreement by providing <strong>us<\/strong> with 4 weeks\u2019 notice in writing.<\/li>\n<\/ul>\n\n\n\n<p><strong>Us<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>15.2 <strong>We<\/strong> will discuss with <strong>you<\/strong> as soon as possible if <strong>we<\/strong> are considering discontinuing <strong>direct payments<\/strong> and why, in order to explore all available options before we make the final decision to end this agreement.<\/li>\n\n\n\n<li>15.3 <strong>We<\/strong> will normally provide <strong>you<\/strong> with 4 weeks\u2019 notice in writing before we end this agreement but reserve the right to provide less or no notice in serious cases for example, where <strong>we<\/strong> believe there is a significant risk of harm or financial abuse<\/li>\n\n\n\n<li>15.4 The circumstances where <strong>we<\/strong> will consider ending this agreement include:\n<ul class=\"wp-block-list\">\n<li>if <strong>you<\/strong> are not complying with this agreement or any of the conditions contained within it and more particularly summarised at <a href=\"https:\/\/www.devon.gov.uk\/adult-social-care\/document\/direct-payment-agreement-terms-and-conditions\/#appendix-c-summary-of-conditions\">Appendix C<\/a><\/li>\n\n\n\n<li>if the <strong>direct payment<\/strong> is not being used to achieve the outcomes in the <strong>support plan<\/strong><\/li>\n\n\n\n<li>if the <strong>recipient<\/strong> no longer needs support or no longer needs support for a short period.<\/li>\n\n\n\n<li>if <strong>you<\/strong> fail to supply sufficient information to support the payments made<\/li>\n\n\n\n<li>if <strong>we<\/strong> no longer believe it is appropriate to make the <strong>direct payment<\/strong><\/li>\n\n\n\n<li>if <strong>we<\/strong> believe that <strong>you<\/strong> are no longer capable of managing the <strong>direct payment<\/strong> or of managing it with support.<\/li>\n\n\n\n<li>where <strong>we<\/strong> are required to do so under legislation, for example where the individual receiving the care is placed by the courts under a condition relating to drug and\/or alcohol dependency<\/li>\n\n\n\n<li>where the <strong>representative<\/strong> no longer wishes to do so, is no longer deemed appropriate by <strong>us<\/strong> and no alternative person can be found.<\/li>\n\n\n\n<li>where the <strong>recipient<\/strong> has lost capacity to consent and there is no appropriate person to<br>manage the <strong>direct payment<\/strong> on their behalf.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>15.5 Ending the agreement will trigger a review of the <strong>recipient\u2019s<\/strong> support needs so <strong>we<\/strong> can plan how their needs can alternatively be met.<\/li>\n\n\n\n<li>15.6 <strong>We<\/strong> will support <strong>you<\/strong> to seek to ensure there are no outstanding contractual liabilities before the <strong>direct payment<\/strong> ends.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"16-concerns-and-complaints\">16: Concerns and complaints<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>16.1 You, your family, and carer(s) should understand how you can prevent, recognise, and report abuse, neglect and exploitation, and any other concerns you may have about your safety or welfare &#8211; for further information on safeguarding, please see s<a href=\"https:\/\/www.devon.gov.uk\/adult-social-care\/safeguarding\/\">afeguarding adults guidance<\/a> as well as <a href=\"https:\/\/www.devonsafeguardingadultspartnership.org.uk\/\" rel=\"noopener\">the Torbay and Devon Safeguarding Adults Partnership website<\/a>.<\/li>\n\n\n\n<li>16.2 <strong>You<\/strong> have the right to complain about the operation of this agreement under the <a href=\"https:\/\/www.devon.gov.uk\/care-and-health\/adults\/contact\/\">Social Care complaints process<\/a>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"17-how-will-your-information-be-used\">17: How will your information be used?<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>17.1 <strong>You<\/strong> agree that <strong>we<\/strong> and the person <strong>you<\/strong> have nominated to manage the <strong>direct payment<\/strong> on <strong>your<\/strong> behalf (if you have one) may share personal information about <strong>you<\/strong> in order to help make sure <strong>your<\/strong> needs are met appropriately.<\/li>\n\n\n\n<li>17.2 <strong>Your<\/strong> personal data is being used by our Adult Care and Health Team for the purposes of assessment, care planning and support delivery via a <strong>personal budget<\/strong> and <strong>direct payment<\/strong>. <strong>We<\/strong> undertake to ensure <strong>your<\/strong> personal data will only be used in accordance with our privacy notice which can be accessed here: <a href=\"https:\/\/www.devon.gov.uk\/privacy\/privacy-notices\/\">https:\/\/www.devon.gov.uk\/privacy\/privacy-notices\/<\/a><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"18-changes-to-this-agreement\">18: Changes to this agreement<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>18.1 <strong>We<\/strong> may change the terms and conditions of this agreement from time to time by advising <strong>you<\/strong> in writing about the change. <strong>We<\/strong> will give <strong>you<\/strong> reasonable notice of these changes and give <strong>you<\/strong> the opportunity to withdraw from the agreement.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"appendix-a-links-to-useful-information-on-direct-payments\">Appendix A &#8211; Disability Focus financial administration services<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"for-people-taking-a-direct-payment-to-employ-a-personal-assistant\">For people taking a direct payment to employ a personal assistant:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Act as a payment agency for all employer liabilities, including but not limited to processing P46 or P45 for personal assistants, issuing pay slips, calculating payments due from timesheets, calculating statutory payments and obtaining refunds from HMRC, holiday leave and pension payments where applicable and within the required time frames. Disability Focus will maintain correct audit procedures in relation to the above activities.<\/li>\n\n\n\n<li>Establish the status of the personal assistant through a signed declaration from the individual to declare that they are registered with HMRC under self-assessment. If such a declaration is not received, then the personal assistant will be advised at that point by Disability Focus that they will be treated for the purpose of payroll as an employee.<\/li>\n\n\n\n<li>When a case is to be closed, Disability Focus contact the direct payment recipient and obtain a final timesheet so that a final payment can be made, P45s issued and the relevant third parties closed, for example, HMRC PAYE Scheme and the Nest Pension Scheme.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"for-direct-payments-recipients-paying-an-agency\">For direct payments recipients paying an agency:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Liaise with service providers regarding all invoices to be paid.<\/li>\n\n\n\n<li>Pay invoices to service providers.<\/li>\n\n\n\n<li>Keep records of payments due and payments made each month.<\/li>\n\n\n\n<li>On account closure contact service providers to arrange to pay the final balance.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"for-people-using-the-prepaid-devon-card\">For people using the (prepaid) Devon Card:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Disability Focus will use the prepaid card system to manage and record payments to providers. All liabilities stay with the cardholder.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"for-people-who-want-a-payroll-only-service\">For people who want a payroll only service:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>All activities are the same as above apart from the action of making payments. For payroll support only, Disability Focus does not have access to the<strong> <\/strong>Devon (prepaid) Card, so they cannot make the payments on behalf of the person.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"disability-focus-will-also-undertake-the-following-general-duties-on-behalf-of-the-council\"><strong>Disability Focus will also undertake the following general duties on behalf of the Council:<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Raise with DCC any concerns as to whether a direct payment is being spent appropriately.<\/li>\n\n\n\n<li>Advise DCC once a final payment has been made and an account can be closed.<\/li>\n\n\n\n<li>Directing a direct payment recipient who is an employer to their employers&#8217; liability insurance provider helpline or Care Direct for HR advice when there is a potential employment issue to be resolved.<\/li>\n\n\n\n<li>Completion of surplus reporting each month.<\/li>\n\n\n\n<li>Assistance in budget profiling and visitations of clients.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"costs\">Costs<\/h3>\n\n\n\n<p>If a direct payment with financial administration support is agreed as appropriate, the costs will be included in your personal budget.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"appendix-c-summary-of-conditions\">Appendix C &#8211; summary of conditions<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"mandatory-conditions\">Mandatory conditions<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The <strong>direct payment<\/strong> is to be used only to pay for arrangements required to meet the needs specified in <strong>your<\/strong> care and <strong>support plan<\/strong>.<\/li>\n\n\n\n<li>Without our written consent, the <strong>direct payment<\/strong> must not be used to pay any person listed below to meet <strong>your<\/strong> care needs or provide you with administrative support:<br>  \n<ul class=\"wp-block-list\">\n<li><strong>Your<\/strong> spouse or civil partner.<\/li>\n\n\n\n<li>A person who lives with <strong>you<\/strong> as if <strong>your<\/strong> spouse or civil partner.<\/li>\n\n\n\n<li>A person living in the same household as you who is <strong>your <\/strong>parent or parent-in-law,   son or daughter, son-in-law or daughter-in-law, stepson or stepdaughter, brother or sister, aunt or uncle, grandparent.<\/li>\n\n\n\n<li>The spouse or civil partner of any person listed above who lives in the same household as <strong>you<\/strong>.<\/li>\n\n\n\n<li>A person who lives with any person listed above as if that person\u2019s spouse or civil partner.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<p>Written consent to pay for the persons listed above will only be provided if <strong>we<\/strong> consider that it is<br>necessary for that person to be paid to meet <strong>your<\/strong> care needs.<\/p>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li>A <strong>direct payment<\/strong> made to an authorised person is made on the condition they must:\n<ul class=\"wp-block-list\">\n<li>notify <strong>us<\/strong> if they reasonably believe that <strong>you<\/strong> no longer lack the capacity to request the making of direct payments<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>If <strong>we <\/strong>have appointed an authorised person is:\n<ul class=\"wp-block-list\">\n<li>a company<\/li>\n\n\n\n<li>a partnership<\/li>\n\n\n\n<li>someone who is not a family member: or<\/li>\n\n\n\n<li>someone who is not a friend of <strong>yours<\/strong> who provides <strong>you<\/strong> with care<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<p>they must obtain \u2013<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>an enhanced criminal record certificate, or<\/li>\n\n\n\n<li>verification that a satisfactory enhanced criminal record certificate has been obtained.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"discretionary-conditions\">Discretionary conditions<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Upon our request <strong>you<\/strong> or the authorised person must provide sufficient information to <strong>us<\/strong> for the purposes of enabling <strong>us<\/strong> to ascertain that:\n<ul class=\"wp-block-list\">\n<li>the making of <strong>direct payments<\/strong> is an appropriate way to meet <strong>your<\/strong> needs<\/li>\n\n\n\n<li>the conditions upon which this <strong>direct payment<\/strong> is made are being complied with,<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Any such request for information will not be:\n<ul class=\"wp-block-list\">\n<li>Made more frequently and in more detail than is reasonably required by<strong> us<\/strong> to ascertain the matters referred to in paragraph 1,<\/li>\n\n\n\n<li>Required in a format which is not reasonably practicable for the adult or authorised person to provide.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Optional [<strong>Your<\/strong> needs may not be met by [name or person or company];]<\/li>\n<\/ol>\n<\/div>\n\n\n\n<div class=\"wp-block-group is-layout-constrained wp-block-group-is-layout-constrained\"><div class=\"document-meta-acf-block clearfix \" id=\"block_acf-block-69bbcd124bea6\"><div class=\" dcc-documents-meta\"><div class=\"dcc-documents-widget dcc-documents-widget-block\"><div class=\"dcc-documents-widget-box2\"><p class=\"dcc-documents-published\"><span>Published<\/span> <time datetime=\"2023-10-26T16:23:23+00:00\">26\/10\/2023 4:23pm<\/time><\/p><p class=\"dcc-documents-updated\"><span>Last Updated<\/span> <time datetime=\"2026-03-19T10:16:52+00:00\">19\/03\/2026 10:16am<\/time><\/p><\/div><\/div><\/div><\/div><\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Agreement This agreement is between the person receiving the direct payment (you) who will be either therecipient or the representative of the recipient and Devon County Council (we or us).
