The Mental Capacity Act governs decision-making on behalf of people, who may lose mental capacity at some point in their lives or where an incapacitating condition has been present since birth. The Act received Royal Assent on 7 April 2005 and came into force in April 2007 (partly) and on 1st October (completely).

Do you have an illness, injury or disability that may cause you difficulties in making decisions? Do you care for, work with, or know someone who has difficulties in making decisions? Do you want to plan ahead in case you are unable to make important decisions for yourself in the future? There is a new law that can help, the Mental Capacity Act 2005. This leaflet tells you how the act can affect you.

If you would like hard copies of the leaflet then please email: makingdecisions@dca.gsi.gov.uk or call the Department for Consitutional Affairs on 020 7210 0038/39.
