Freedom of Information

Reuse of Public Sector Information

The Reuse of Public Sector Information Regulations came into force in 2005 and was established to allow people to apply to re-use information held by the Council. ‘Re-use’ means using the information for a purpose other than the purpose for which the document was originally produced. This could include a commercial purpose.

The new directive does not provide access to the information itself.  Such access is available through the Freedom of Information Act, Data Protection Act or other access to information regimes such as the Environmental Information Regulations.

How to make a request

You must;

  • put your request in writing
  • state your name and address
  • specify the document which you want to re-use.

Response time

We must respond to your request within 20 working days but there may be occassions where it is necessary to extend this time frame. Where this happens we will tell you before the end of the 20 working days why we are extending the time limit and the date on which we expect to be able to respond.

Requests may be refused if:

  • The document contains information in which intellectual property rights are owned by a third party
  • The content of the document is exempt from disclosure under the Freedom of Information Act 2000
  • The document falls outside the Council’s statutory functions

If your request is refused we will inform you in writing of the reason for this. If you are not happy with how we have handled your request you have the right to appeal and ask for an internal review to be carried out. You must lodge this appeal within 40 days of receiving your initial response.

Following the outcome of the internal review if you are still unhappy you can write to the Office of Public Sector Information.

A fee may be charged

We may charge a reasonable fee for allowing you to re-use our information. A cost breakdown can be provided upon request.
