RESOLVED that the minutes of the meeting held on 18 October 2010 be signed as a correct record.
*35 Urgent Items
(Items taken under Section 100B(4) of the Local Government Act, 1972
The Chairman had decided that the Committee should take the following items as a matter of urgency because of the need for the matters involved to be addressed as soon as possible.
(a) Potholes and Winter Maintenance
The Area Engineer (East) reported on road repairs being undertaken by gangs of workmen dealing with potholes in a interim fashion systematically working round the network, starting with the most major roads. There were 4 gangs working in the Mid Devon area. Members asked questions about the cost per pothole, possible town and parish council involvement with potholes and snow clearing, whether the pothole strategy was cost effective, especially filling potholes in damp or cold conditions. Members went on to discuss the clearing of snow and gritting of bus routes, whether all bus routes should be cleared and the frequency of service criteria for clearing bus routes.
(b) Cheriton Bishop
Members and officers discussed the concern raised regarding the continued speeding at the junction between Crediton Road and the Old A30 in Cheriton Bishop and the results of the safety audit. The Area Engineer agreed to investigate.
*36 Devon and Torbay Local Transport Plan 2011-2026: Implementation Plan for Devon and Proposed 2011/12 Programme
(Councillor Hannon declared a personal interest in this item by virtue of his membership of Sustrans)
The Committee considered the report of the Area Engineer (East) (EEC/11/44/HQ - text only | pdf EEC/11/44/HQ) outlining the proposed programme for the first year of the statutory Local Transport Plan LTP3 for Devon Torbay 2011 - 2016 in accordance with the local transport capital settlement announced by Government on 13 December 2010. The proposed programme was approved at the Cabinet meeting on 9 March 2011. Members also received a presentation on the Plan from Mr Andrew Ardley, Transportation Manager (Policy), on the key points of the plan, the partners and funding context, capital programmes and other potential funding sources.
Members made comments and asked questions in relation to:-
lack of funding on roads between Taunton and Exeter;
whether we should be spending more money on rain travel, especially rural rail services;
unfair pressure to fund highways, especially M5 junction 28;
whether schemes which do not appear in the programme will ever be undertaken;
important that this Committee continues to have a say in what happens to DCC transport funding in Mid Devon, as it used to in the past with discretionary schemes.

RESOLVED that the Committee
(a) notes the funding provisions which have been included in report EEC/11/35/HQ - text only | pdf | supplementary information EEC/11/35/HQ - Devon and Torbay Local Transport Plan 2011-2026: Implementation Plan for Devon and Proposed 2011/12 Programme which was presented to Cabinet on 9 March;
(b) express its concern to Cabinet that Mid Devon Members now have no say in the LTP Programme for the Mid Devon area which appears contrary to the localism initiative espoused by the Government.
*37 Safety Concerns B3181, Toad Hall (Padbrook) Roundabout, Cullompton
The Area Engineer (East) was asked to investigate, and report back to the next meeting on, issues relating to visibility at the Bradninch Hill roundabout on the B3181, which was raised by Councillor Snow. The Committee noted the report of the Area Engineer (East) (EEC/11/45/HQ - text only | pdf EEC/11/45/HQ) on the crash data and contributory factors.
*38 Halberton High Street
The Area Engineer (East) was asked to investigate, and report back to the next meeting on enforcement against obstruction of the pavement in Halberton High Street, as raised by Councillor Hannon.
The Committee noted that a discussion was held with Councillor Hannon regarding the obstruction and it was confirmed that no enforcement could be taken regarding the vehicles that parked on the virtual footway as the road markings for this footway were only advisory markings and not mandatory. The only effective restriction would be a Clearway Order, which would have consequent detrimental effects on parking in the area. Councillor Hannon accepted the situation.
*39 Pay and Display Parking Schemes
The Committee noted that following its resolution on 18 October 2010 that the Committee s position on Pay and Display (i.e. that it does not, now or in the future, support On-Street Pay and Display in Mid Devon Towns) be reaffirmed and that the Cabinet be made aware of the Committee s continuing concerns , Cabinet made the following resolution (Minute 264(d) refers):-
RESOLVED that the Highways Traffic Orders Committee s comments be noted but it be reminded that the existing policy was re-affirmed by the full County Council on 2 October 2010 (albeit with a streamlined process for advertising proposals following consultations with the Cabinet and local Member); that the points made by the HATOC both in June 2010 and again on 18 October were clearly restated by members of that Committee at the County Council meeting but the Council was not persuaded by those arguments and had exercised its democratic will not to change the existing policy.
*40 Graffiti on Highway Structures and Street Furniture
Councillor Wilson requested that in accordance with the Anti Social Behaviour act 2003 graffiti be removed from numerous signs in Tiverton and surrounding areas which had been defaced. The Area Engineer (East) said that he would deal with any graffiti his team is made aware of and asked Councillor Wilson to identify the sites he was concerned about.
*41 Actions Taken Under Delegated Powers
The Committee noted the report of the Area Engineer (East) (EEC/11/46/HQ - text only | pdf EEC/11/46/HQ) detailing the actions taken under delegated powers since March 2010 and, where appropriate, in consultation with the Chairman and Local Members.
*42 Items for Future Meetings
The Committee proposed that the following items be placed on future meetings of this Committee:-
Reorganisation of the Highway Management teams (next meeting);
Issue of tickets in restricted parking areas.
It was MOVED by Councillor Way, SECONDED by Councillor Hannon and
RESOLVED that in future the Mid Devon Hatoc Committee meet at 11am rather than 11.30am.
*43 Dates of Future Meetings
The Committee noted that the following dates were in the County Council calendar:
20 June 2011, 17 October 2011 and 12 March 2012
