RESOLVED that the Minutes of the meeting held on 26 November 2008 be signed as a correct record.

*266 Urgent Business: Proposed Windfarm, Holsworthy Area

(An item taken under Section 100B(4) of the Local Government Act, 1972)

The Chairman had decided that the Committee should take this item as a matter of urgency because of the need for it to be considered as soon as possible.

The Executive Director of Environment, Economy and Culture reported the receipt of a consultation from Torridge District Council on an application for a windfarm in the Holsworthy area on which a response was sought by 19 February 2009. It was agreed that a site visit by the full Committee should be held on the same day as that proposed for the New North Devon College application (see Minute *269 below).

MATTERS FOR DECISION

*267 County Matter: Waste Disposal

East Devon District: Use of Existing Industrial Unit for Waste Transfer of Commercial Waste and Use of the Land adjacent to Building for Skip Storage and Storage of Associated Equipment at Land at Unit 38a, Greendale Barton Business Park, Woodbury Salterton

(Councillor Button declared a personal interest by virtue of being a member of East Devon District Council and a member of its Development Control Committee. Councillors Giles, Nicholson and Wragg declared a personal interest by virtue of being members of East Devon District Council)

The Committee considered a report by the Executive Director of Environment, Economy and Culture (EEC/09/15/HQ - text onlyEEC/09/15/HQ) on a proposal to use part of an existing industrial building for waste transfer purposes with the use of the land outside of the building for storage of skips.

The Executive Director of Environment, Economy and Culture reported that 3 additional objections had been received, and that Councillor Channon, the local County Councillor, had no objections to the application subject to the imposition of conditions referred to by the Woodbury Salterton Parish Council and the Environment Agency. The Executive Director recommended that additional conditions be imposed on a planning consent to reflect the conditions imposed by the Planning Inspector on the recently allowed appeal for the adjacent waste transfer building.

It was MOVED by Councillor Cox, SECONDED by Councillor Button and

RESOLVED that planning permission be granted subject to conditions relating to, inter alia, standard time limit, hours of operation, access via internal haul road from the A3052 only, annual capacity limit of 25,000 tonnes, no waste to be stored or deposited anywhere outside of the building, dust and odour control, no additional lighting and no use of the site by members of the public.

Town and Country Planning General Regulations 1992 - Regulation 3

South Hams District Council: Erection of a Bespoke Steel Framed and Stretched PVC Fabric Canopy Structure within the School Playground to provide Protection from Sun and Inclement Weather at West Alvington C of E Primary School, West Alvington, Kingsbridge

The Committee considered a report by the Executive Director of Environment, Economy and Culture (EEC/09/16/HQ - text onlyEEC/09/16/HQ) on a proposal for the erection of a bespoke steel framed and stretched PVC fabric canopy structure within the school playground to provide protection from sun and inclement weather at West Alvington C of E Primary School.

It was MOVED by Councillor Cox, SECONDED by Councillor Button and

RESOLVED that pursuant to Regulation 3 of the Town and Country Planning General Regulations 1992, planning permission be granted subject to conditions including, standard commencement, and development in accordance with submitted plans and details.

*269 Planning and Highway Consultation

North Devon District: Proposed Construction of New North Devon College, Seven Brethren, Barnstaple

(Councillor Cann declared a personal interest by virtue of being a member of North Devon District Council)

The Executive Director of Environment, Economy and Culture reported that the County Council, as the Strategic Planning and Highway Authority, had received a consultation from North Devon Council on the above application to which a response was sought by mid-March 2009 to enable it to determine the application as soon as possible. A full report would be prepared for the next meeting of the Committee on 11 March 2008. It was however recommended that a site visit be held in advance of the meeting to enable members to be aware of all the relevant issues.

The Executive Director indicated that copies of the Non Technical Summary of the Environmental Statement which accompanied the application were available from him and that a full copy of the Environmental Statement and all the relevant planning application documents could be viewed on North Devon Council s website (Application No 47650).

It was MOVED by Councillor Cox, SECONDED by Councillor Button and

RESOLVED that a site visit be held by the full Committee on the morning of 11 February 2009.

Quarterly Report on the Handling of County Matter and County Council Development Planning Applications 1 October to 31 December 2008

The Committee considered a report by the Executive Director of Environment, Economy and Culture (EEC/09/19/HQ - text onlyEEC/09/19/HQ) outlining the County Council s performance in the handling of County Matter and County Council Development Planning Applications in the period 1 October to 31 December 2008.

It was MOVED by Councillor Cox, SECONDED by Councillor Button and

RESOLVED that the report be noted.

The Committee received and noted the schedules of action taken by the Executive Director of Environment, Economy and Culture under delegated powers (EEC/09/17/HQ - text onlyEEC/09/17/HQ).

*272 Update Report on the Outcomes of Previous Strategic Planning/Highway Consultation Responses made by the County Council's Development Control Committee

The Committee received and noted the schedule of decisions made by the District Councils and others in respect of strategic planning/highway consultations which it had previously considered (EEC/09/18/HQ - text onlyEEC/09/18/HQ).
