(a) Confirmation

RESOLVED that the Minutes of the meeting held on 23 April 2008 be signed as a correct record.

(b) Matter Arising:

Minute 224

The Director of Environment, Economy and Culture reported that Improving our Performance was an issue that had previously been raised and consequently it had been considered at the Members training event earlier in the day.

RESOLVED that a report on performance improvement, particularly with regard to delegation arrangements be brought to the next meeting of the Committee.

*228 Urgent Business / Ruby Waste Management Site

(An item taken under Section 100B(4) of the Local Government Act, 1972)

The Chairman had decided that the Committee should take this item as a matter of urgency.

The Director of Environment, Economy and Culture gave an update on the Ruby Waste Management Site, particularly breaches of condition notices and the current situation regarding enforcement action.

It was MOVED by Councillor Cann and SECONDED by Councillor McInnes and

RESOLVED that;

(a) legal advice be obtained from the County Solicitor on the validity and appropriateness of undertaking a Members site visit in view of the current breaches, ongoing enforcement actions and current appeal situation; and;

(b) subject to (a) above, that a representative group of three / four Members, including the Chair and Vice Chair undertake a site visit on a date to be arranged.

*229 County Matters

(a) County Matter - Waste Disposal: Torridge District Proposed Waste Transfer Station at Winkleigh Airfield

(Councillor Hosking declared a non-prejudicial interest by virtue of his Chairmanship of the Tamar Valley AONB Partnership. Councillor Ford declared a personal interest by virtue of being a member of Torridge District Council. Councillor Radford declared a personal interest by virtue of his involvement with farming)

(Mr Bullen (Winkleigh Parish Council), Ms Metcalfe and Mr Hampshire (Agent) attended this item under the Council s Public Participation Procedures)

The Committee considered the report of the Director of Environment, Economy and Culture (EEC/08/115/HQ - text only | pdf EEC/08/115/HQ) giving further consideration to the proposal for a Waste Transfer Site on land situated on Winkleigh Airfield to the north of the A3124.

It was MOVED by Councillor Cox and SECONDED by Councillor Nicholson and

RESOLVED that a full Committee site visit (to which the Local Member will attend) to take place on the Tuesday 24 June 2008.

(b) County Matter Planning Application: South Hams District Council: Removal of Condition 1 of Permission 08/0715/03/CM (Temporary 5 Year Permission, Expiring on 16.06.2008) to Permit a Permanent Recycling and Storage Operation at Torr Quarry, Buckland Tout Saints, Totnes, Devon

The Committee considered the report of the Director of Environment, Economy and Culture (EEC/08/116/HQ - text only | pdf EEC/08/116/HQ) which related to a proposal to lift a temporary condition on an existing inert waste recycling site, thereby making the permission permanent.

It was MOVED by Councillor Cox and SECONDED by Councillor Clatworthy and

RESOLVED that, pending the receipt of the noise assessment and the consultation responses on the matter, that a representative group of 3 / 4 Members, including the Chair and Vice Chair visit the site, on Wednesday 25th June 2008, to consider the various issues and representations relative to this application, particularly with regard to matters concerning noise and dust, and that the Parish Council be notified of the date.

(c) West Devon Borough: Proposal on Farm Composting of Biodegradable Green Waste at Broadwell Farm, Gulworthy, Tavistock, Devon, PL20 8JW

Councillor McInnes declared a personal interest by virtue of being a member of West Devon Borough Council)

(Mr Pope (applicant) attended for this item under the Council s Public Participation Procedures)

The Committee considered the report of the Director of Environment, Economy and Culture (EEC/08/117/HQ - text only | pdf EEC/08/117/HQ) which related to a proposal for the composting of green waste at Broadwell Farm for use on the farm.

It was MOVED by Councillor McInnes and SECONDED by Councillor Davis and

RESOLVED that planning permission be granted subject to conditions including: accordance with plans; 5 year temporary permission; composting of green waste only; compost for the sole use of Broadwell Farm; no public delivery or collection to the site; limit to a maximum of 1,000m3 waste to be brought onto the site every 6 months; limit height of windrows and stockpile to 3 metres; number of deliveries restricted to 2 per day; restriction on hours of operation; limit on hours of use of plant and machinery; control of Japanese knotweed; routing; use of tractor and trailers to deliver green waste; improvements to the access; and the control of mud and dust at the access.

(d) County Matter - Waste Disposal: East Devon District: Erection of Building and Associated Compound for Kerbside Waste Transfer at Greendale Barton Industrial Estate, Woodbury Salterton

Councillors Button, Giles, Nicholson and Wragg each declared a personal interest by virtue of their membership of East Devon District Council)

Anne Hunt (objector) attended this item under the Council s Public Participation Procedures)

The Committee considered the report of the Director of Environment, Economy and Culture (EEC/08/118/HQ - text only | pdf EEC/08/118/HQ) which related to the resubmission and revision of a previously refused planning application for a new industrial building and compound area to accommodate waste arising from kerbside recyclable collections in the East Devon area.

The local Member had also submitted written comments which the Committee considered.

It was MOVED by Councillor Cox and SECONDED by Councillor Ford and

RESOLVED that the decision be deferred in order to examine the potential alternative sites in the East Devon catchment area, and again to visit the site, on Tuesday 24 June 2008 (full Committee) in order to assess the proposed mitigation measures in relation to the likely impacts of the development.

*230 County Council Development

(a) West Devon Borough: Outline Application for the Construction of New School, Nursery, Children s Centre and Associated Access and Parking at Land off Baldwin Drive, Okehampton

(Councillor McInnes declared a personal interest by virtue of being a member of West Devon Borough Council)

The Committee considered the report of the Director of Environment, Economy and Culture (EEC/08/119/HQ - text only | pdf EEC/08/119/HQ) which related to an outline application for the construction of a new primary school and Children's centre at Okehampton.

It was MOVED by Councillor McInnes and SECONDED by Councillor Ford and

RESOLVED that subject to receipt of a satisfactory Flood Risk Assessment, the Director of Environment, Economy and Culture be authorised, pursuant to the provisions of Regulation 3 of the Town and Country Planning Regulations 1992, to grant planning permission subject to conditions including: standard commencement; a restriction of vehicular access to the link road from Crediton Road; that no development takes place until the link road is constructed; site security; submission of details of final design, layout, and materials to be used; pedestrian access, implementation of a scheme of archaeological recordings; implementation of a scheme of sustainable urban drainage and a school green travel plan (and its implementation).

(b) South Hams District; Construction of Replacement Playing Fields Pavilion at Westville Playing Field, Kingsbridge Community College, Balkwill Road, Kingsbridge

The Committee considered the report of the Director of Environment, Economy and Culture (EEC/08/120/HQ - text only | pdf EEC/08/120/HQ) which related to the replacement of an existing redundant playing field pavilion with a new sports pavilion.

It was MOVED by Councillor Cann and SECONDED by Councillor Davis and

RESOLVED that the decision be deferred to reconsider the design with the Applicant, in light of the revised drawings that were made available at the meeting.

(c) North Devon District Council: Multi Use Hall at Marwood County Primary School,

Marwood, Whiddon, Muddiford, Barnstaple

The Committee considered the report of the Director of Environment, Economy and Culture (EEC/08/121/HQ - text only | pdf EEC/08/121/HQ) which related the proposed erection of a multi-use Hall at Marwood County Primary School, near Barnstaple.

It was MOVED by Councillor Davis and SECONDED by Councillor Ford and

RESOLVED that the Director of Environment, Economy and Culture, pursuant to the provisions of Regulation 3 of the Town and Country Planning Regulations 1992, be authorised to grant planning permission subject to conditions including: standard 3 year commencement; accordance with plans, materials to be used; and the prior agreement of a scheme for use of the hall by the local community (to include opening hours and frequency of usage).

(d) South Hams District: Erection of New Pre-School Nursery Unit and Alterations to Car Park at Ermington Community Primary School, School Lane, Ermington, Ivybridge

The Committee considered the report of the Director of Environment, Economy and Culture (EEC/08/122/HQ - text only | pdf EEC/08/122/HQ) which related to an application for the construction of a pre-school facility adjacent to the primary school in Ermington.

It was MOVED by Councillor Clatworthy and SECONDED by Councillor Ford and

RESOLVED that subject to the receipt of satisfactory details of the boundary treatment and to further consideration of the design and materials with relation to the Conservation Area, the Director of Environment, Economy and Culture be authorised to grant permission using delegated powers pursuant to Regulation 3 of the Town and Country Planning General Regulations 1992 and subject to conditions relating to: standard commencement; use of materials; stonework to be approved; implementation and maintenance of landscaping.

OTHER MATTERS

*231 Section 106/278 Agreements Bonding of Contributions


The Committee considered the report of the Director of Environment, Economy and Culture (EEC/08/123/HQ - text only | pdf EEC/08/123/HQ) which assessed the benefits of financial contributions being bonded in the same manner as highway works.

It was MOVED by Councillor Cox and SECONDED by Councillor Davis and

RESOLVED that a policy be adopted which requires the bonding of developer's financial contributions secured under Section 106/Section 278 Agreements with immediate effect.

RESOLVED that the report be noted.

*233 Decisions Taken by District Councils etc on Previous Consultation Responses Made by Committee

The Committee considered the update report of the Director of Environment, Economy and Culture (EEC/08/125/HQ - text only | pdf EEC/08/125/HQ), on the outcomes of previous strategic planning/highway consultation responses made by the Committee.

Clarification was sought on why consent was still awaited for application number 42500 when no objections had been raised.

RESOLVED that the report be noted and that the officers would seek clarification for the delay in the above application, and report to the next meeting.
