What is Civil Parking Enforcement (CPE)?

This is the name given to parking enforcement when the power to enforce parking offences transfers from the Police to local authorities. In May 2008 the responsibility for parking enforcement was transferred to Devon County Council by Devon & Cornwall Police.

This transfer allows the Police to focus on tackling more serious crimes. It also allows the eight district councils, working in partnership with Devon County Council, to link parking enforcement in car parks and on-street with their other transport priorities: reducing congestion, improving air quality and promoting road safety.  

The council is a member of the Parking and Traffic Regulations outside London (PATROL) Adjudication Joint Committee. The Joint Committee publishes an Annual Statement of Accounts which is subject to External Audit and the arrangements and timetable for 2009/10 can be found here.

Additional Enforcement Powers

On 1^st June 2009 Devon County Council and its District Partners, along with all other Civil Parking Enforcement Areas outside London, were granted additional powers to enforce double parking offences, and parking at dropped kerbs or raised carriageways at crossing points, cycle lanes and driveways. Motorists who commit these offences will be liable for a £70 Penalty Charge Notice (PCN) from 1 January 2010.

Double Parking is defined as “any vehicle wholly parked more than 50cms from the kerbside” and considered to be an obstacle or a hazardous to other road users.

Vehicles parked alongside dropped kerbs at pedestrian crossings, or raised carriageway informal crossing points, and cycle lanes will also be liable for a £70 PCN.

Penalty Charge Notices

The enforcement of access to private driveways is unlikely to be considered a priority by the Council over other road safety enforcement and will therefore, only take place when a CEO is available, and provided house owner is at home if a CEO is able to attend.

CEO’s have no powers to remove a vehicle blocking or restricting a private driveway. The Police need to be contacted and they may be able to use Police powers to deal with obstruction offences to get an offending vehicle removed.
