I recently sent a note to Derek Fish explaining the situation about NVQ. attached below and setting out new policy guidance also below.

(possible) Pro's / cons of being employed by PCT  

  • If care is under the direction of NHS health care professional care assistants do not need to be registered with NCSC.
  • Clinical Governance arrangements of NHS prevail
  • funding arrangements may be adversely affected if it is all NHS care may not access LA funds

(possible) Pros / cons of carer being employed by LA

  • Need to registered with NCSC unless under delivering care  only under the direction of health care professional
  • Carer will probably already be working from a registered domiciliary care agency and may undertake other tasks under the training and direction of health care professionals
  • With regard to attaining the NVQ I think the standard is quite helpful it says new employees must hold an award within three years, and register for an award within the first six months.
  • Will be able to access Local Authority funding
  • If HCA did tasks under the direction of a care managed social care plan they would need to be supplied from a registered domiciliary care agency and have to attain NVQ as above
