Definitive Map Review

Yealmpton

The Wildlife and Countryside Act 1981 requires the County Council to keep the Definitive Map of public rights of way under continuous review and to make modifications where it appears that routes should be added, amended, regraded or deleted.  A review is currently being undertaken in the Parish of Yealmpton. A claim has been made for modification of the Definitive Map:

Route 1: Schedule 14 application for the upgrading of Footpath No. 33 to a Byway Open to All Traffic (SX 5808 5310 – 5925 5287).

Maps showing existing public rights of way and the claimed upgrade are available for inspection at:

The Definitive Map and Statement is the legal record of public rights of way. There are four categories:

  • Footpath – a highway over which the public have a right of way on foot only
  • Bridleway – a highway over which the public have a right of way on foot, on horseback or leading a horse, or on a bicycle
  • Restricted Byway – a highway over which the public have a right of way on foot, on horseback or leading a horse, on a bicycle, or in a horse-drawn carriage, but not for motorised vehicles
  • Byway Open to All Traffic – a highway over which the public have a right of way for vehicular and all other kinds of traffic, but which is used by the public mainly as a footpath or bridleway. (As a result of the Natural Environment & Rural Communities Act 2006, applications made after January 2005 to record Byways Open to all Traffic can result in the recording of restricted byways only, unless certain exceptions apply.)
