Definitive Map Review

Woolfardisworthy (Mid Devon)

The Wildlife and Countryside Act 1981 requires the County Council to keep the Definitive Map of public rights of way under continuous review and to make modifications where it appears that routes should be added, amended or deleted. A review is currently being undertaken in Woolfardisworthy Parish and eight suggestions for change have been proposed and published on the parish consultation map.

Maps showing the existing public rights of way and the eight suggestions to modify the Definitive Map are available for inspection:

The Definitive Map is the legal record of public rights of way. There are four categories

  • Footpath - a highway over which the public have a right of way on foot only.
  • Bridleway - a highway over which the public have a right of way on foot, horseback, leading a horse or on a bicycle.
  • Restricted byway – a highway over which the public have a right of way on foot, horseback, leading a horse, or with a non-mechanically propelled vehicle.
  • Byway open to all traffic - a highway over which the public have a right of way with all traffic but which is mainly used as a footpath or bridleway

The eight suggestions are

1 Proposed diversion of Footpath No 19, Woolfardisworthy from a point on the county road between Woolfardisworthy and Tridley Foot Cross at the entrance to Barton House (GR SS8270 0868) eastwards to a point by the field gate (GR SS8271 0868) then south westwards across the field to a gateway (GR SS8263 0858). Included as the recorded line of the path has been obstructed by the construction of Barton House

2 Proposed variation of particulars to amend the line of Footpath No 24, Woolfardisworthy at Glebe Farm and The Old Rectory from a point on the county road (GR SS8286 0848) going east north eastwards through Glebe Farm yard (GR SS 8296 0850) or from a point further south on the county road (GR SS8285 0844) running north eastwards and then northwards through The Old Rectory to Glebe Farm yard (GR SS 8296 0850). Included as the recorded line of the footpath includes a section which crosses into The Old Rectory from Glebe Farm and then back to Glebe Farm which is unusable. Previous owner of Glebe Farm also maintained that the description in the definitive statement described the route of the footpath as passing through The Old Rectory and entering Glebe Farm at the east end of the farmyard.

3 Proposed diversion of Footpath No. 8, Woolfardisworthy in the vicinity of Coppice Plantation, West Emlett from a route that leaves West Emlett Lane (GR SS8040 0844) and proceeds westwards across Coppice Plantation to rejoin West Emlett Lane (GR SS8032 0842) to a route that continues southwards down West Emlett lane, staying east of Coppice Plantation, to the junction with Footpaths Nos 10 and 31, Woolfardisworthy (GR SS8041 0835).  Included as the diversion of this footpath was requested by the Parish Meeting during the uncompleted review of 1977.

4 Proposed deletion of Footpath No. 11, Woolfardisworthy from the junctions with Footpaths Nos 6 and 7 north east of Berry Castle Fort on West Emlett driveway (GR SS 8024 0939) going east, south eastwards and then east north eastwards to the county road between Tridley Foot Cross and Black Dog (GR SS 8094 0936).  Included as the deletion of this footpath was requested by the Parish Meeting during the uncompleted review of 1977.

5 Proposed deletion of Footpath No.29, Woolfardisworthy from the county road between Littleborough Cross and Riverside Cross (GR SS8260 0964) going north eastwards through Hudgery Farm to the parish boundary with Puddington south east of Brindifield Plantation (GR SS8307 0997).  Included as the deletion of this footpath was requested by the Parish Meeting during the uncompleted review of 1977.

Suggestion 5 Plan (2.6MB TIF file)

6 Proposed upgrading of Footpaths No. 6, 7, 8 (part) and10 (part) Woolfardisworthy to a bridleway and the addition of a bridleway.  Starting from the Kennerleigh to Black Dog road, south of Trindley Down (GR SS8104 0854) going west along West Emlett Lane, then south and then west through West Emlett Farm, and then north along West Emlett drive to the Morchard Bishop to Black Dog road near East Brownstone (GR SS8024 0963). Included as a number of user evidence forms completed by horse riders were received in 2008 and there have also been recent complaints from horse riders about a locked gate along the route.

7 Proposed upgrading of Footpaths No. 13, 16 & 17, Woolfardisworthy to a bridleway from the Black Dog to Puddington road (GR SS8098 0992) going east then south along Densham Lane, pass Little Densham to the county road between Woolfardisworthy and Tridley Foot Cross (GR SS8136 0909) and with another route turning east before Little Densham to East Densham (GR SS8270 0940) then going south east through Densham Plantation and along a field headland to the county road south of Bowerhay Cottage (GR SS8277 0875).  Included as a number of user evidence forms completed by horse riders were received in 2008 for use of this route on horseback.

8 Proposed extinguishment of Footpath No. 22 (part), Woolfardisworthy from the junction with Footpath No, 32, Woolfardisworthy (GR SS8093 0773) going west along the field headland, across the stream at the south end of Langham Plantation (GR SS8087 0776) and continuing along the field headland to join the north end of Scotland Lane, Restricted Byway No. 36, Woolfardisworthy (GR SS 8077 0780).  Included as this section of footpath would appear to be no longer needed for public use as the adjacent unsurfaced unclassified county road (now maintained by public rights of way) runs parallel to the path.
