The Freedom of Information Act 2000 (FOIA) gives a general right of access by the public to all types of recorded information held by public authorities such as Devon County Council. Any person who makes a request to the county council for information must be told whether or not the information is held at Devon County Council and subject to exemptions, be supplied with that information within 20 working days. Requests for information should be made in writing to the Information Governance team (details to the right). Requests should include the name of the requester and suitable contact details for said requester.
The public also have a right to access information regarding the Environment under the provisions of the Environmental Information Regulations 2004 (EIR). Much like the FOIA, these regulations allow access to certain information about the environment within 20 working days.
Individuals already have the right of access to information held about themselves under the Data Protection Act and are also able to request environmental information under the provisions of the EIR.
Devon County Council operates a Publication Scheme which lists categories of information that are already available, including any charges that may be applied. Information not available through the publication scheme may be available on request, subject to any exemptions that may be applied.
