Definitive Map Review

Cruwys Morchard

The Wildlife and Countryside Act 1981 requires the County Council to keep the Definitive Map of public rights of way under continuous review and to make modifications where it appears that routes should be added, amended or deleted. A review is currently being undertaken in Cruwys Morchard Parish

Maps showing the existing public rights of way and one suggestion to modify the Definitive Map were published in February 2011.

Addition of a restricted byway from the county road at Vulscombe Cross proceeding east along Vulscombe Lane pass Higher, Middle & Lower Vulscombe and continuing east north eastwards pass Riverside and across the River Dart at the parish boundary and then proceeding north east and then north west pass Withleigh Mill to the county road B3137 opposite Mill Farm (in Tiverton parish), SS888119 to SS897122; and the addition of a restricted byway from Vulscombe Lane north east of Riverside proceeding south east pass Groubear Farm to the county road known as Thorn Hill, SS898121 to SS901119.

A report on the above suggestion was presented to the Public Rights of Way Committee on 2nd June 2011 and the committee members resolved that Modification Orders be made to modify the Definitive Map and Statement to add restricted byways between points E-D-F and A-B-C-D as shown on drawing number ED/PROW/11/14a (Suggestion 1).

The closing date for any representations or objections to be made to the Orders is the 10th January 2012.

The Definitive Map is the legal record of public rights of way. There are four categories:

  • Footpath - a highway over which the public have a right of way on foot only.
  • Bridleway - a highway over which the public have a right of way on foot, horseback, leading a horse or on a bicycle.
  • Restricted byway – a highway over which the public have a right of way on foot, horseback, leading a horse, or with a non-mechanically propelled vehicle.
  • Byway open to all traffic - a highway over which the public have a right of way with all traffic but which is mainly used as a footpath or bridleway.
